Slow return of house due to prolonged lawsuits
On September 20, recorded at house number 6 Tran Hung Dao street, Vung Tau ward (HCMC), this is a restaurant that is still operating on weekends.
According to research, the above house was previously owned by Mr. P.N. H, with an area of about 850m2. In 1984, when Mr. H went abroad, he lent the house to the local authorities for public use and would request to return the house after returning home.
In 1997, this land was contracted by functional agencies of Ba Ria - Vung Tau province (formerly) to Ba Ria - Vung Tau Investment Service Company (a state-owned enterprise) for lease for a term of 50 years to use as an office. In 2001, this enterprise was equitized, renamed Investment Service Joint Stock Company, and was granted a certificate of land use rights for the above land.
In 2005, Mr. H authorized others to carry out procedures to recover the house. In 2013, the People's Committee of Ba Ria - Vung Tau province (formerly) issued a decision to return this house to Mr. H.
This decision was sued by Investment Service Joint Stock Company because it believed that its interests were affected. Through many levels of trial, in 2018, the Council of Judges of the Supreme People's Court determined that Mr. H was eligible to return the house; the Ba Ria - Vung Tau Provincial People's Committee's return of the house to Mr. H is in accordance with regulations; however, it is necessary to resolve the rights of the enterprise when it has been equitized. Therefore, the court overturned the appellate judgment for retrial according to regulations.
After that, this enterprise continued to sue the decision of the People's Committee of Ba Ria - Vung Tau province on the revocation of the land lease decision. The case continued to be tried according to regulations and the competent court rejected the enterprise's request in 2024. But so far, Mr. H has not received the assets.
Local authorities request resolution of the case in October 2026
In fact, land plot No. 6 Tran Hung Dao in recent years has not been used as a business office, but is deploying dining establishments to serve people and tourists.
According to Vung Tau Ward People's Committee, the locality has just organized working sessions with specialized agencies to clarify the legal basis and responsibilities of each unit to handle the return of property to people.
In which, Vung Tau Ward People's Committee has requested the Department of Construction to report to the Chairman of Ho Chi Minh City People's Committee on the basis and legal basis for handing over the house to Mr. P.N. H, thereby clearly defining the authority of the Chairman of the Ward People's Committee in the case to have a basis for implementation.
Request the Department of Finance to determine the asset value of the enterprise; organize the revocation of business licenses at address No. 6 Tran Hung Dao, Vung Tau ward according to regulations. Request the Department of Agriculture and Environment to organize the revocation of the Certificate of Land Use Rights of Investment Service Joint Stock Company and land lease contracts...
The locality also requested relevant departments and branches to speed up the progress and resolve the case in October 2026. After receiving sufficient valid dossiers, Vung Tau Ward People's Committee will carry out procedures to issue Land Use Right Certificates to citizens within 20 working days according to regulations.
