Cam Giang Commune People's Committee has just organized coercion to force the implementation of remedial measures against Mr. Vu Minh Thoai (residing in Mau An village) for not complying with the Decision on sanctioning administrative violations in the field of land and remedial requirements according to regulations.
According to the case file, Mr. Vu Minh Thoai arbitrarily changed the land use purpose of rice land to another type of land in the agricultural land group; built works, leveled ground, dug ponds, and built embankments on agricultural land in Ha Vi field area, Mau An village. Mr. Thoai also had acts of encroaching on public land managed by the State.
Although functional agencies repeatedly inspected, made records, propagated, mobilized and requested compliance with legal regulations, Mr. Thoai still continued to hire workers to build walls and raise the foundation higher. By the time of organizing coercion, he had not fully implemented the measures to remedy the consequences according to the issued decision.
Based on the Law on Handling of Administrative Violations and guiding documents for implementation, the Chairman of Cam Giang Commune People's Committee issued a decision to enforce and force the implementation of remedial measures for the above violation case.
The content of coercion includes demolition and relocation of illegal construction works on agricultural land; restoring the original state of land before violations; and returning the encroached public land area to the State for management.
In the process of organizing implementation, participating forces shall follow the correct order and procedures according to the provisions of law, ensuring publicity, transparency, objectivity, safety of people and property, and maintaining security and order in the area.
According to Cam Giang Commune People's Committee, the coercion aims to definitively handle the violation case, contributing to improving the effectiveness and efficiency of state management of land; strengthening the awareness of law compliance of organizations and individuals and preventing similar violations.
Through the case, the Commune People's Committee requests organizations, households and individuals in the area to strictly comply with the provisions of law on land, construction and environmental protection; not to arbitrarily change land use purposes, encroach on public land or build illegally. All violations will be strictly handled according to regulations.
In the coming time, Cam Giang Commune People's Committee will continue to strengthen propaganda and dissemination of laws; promote inspection and supervision of land management and use in the area to promptly detect, prevent and handle violations.
