On March 20, the People's Committee of Da Nang City held a Conference to disseminate and implement Conclusions, Resolutions, Decrees, and Plans of the Central and City on specific mechanisms and policies to remove difficulties and obstacles related to projects and land in inspection, examination, and judgment conclusions in the area. The People's Committee of Da Nang City said that from 2012 to 2020, the city had 4 Conclusions of the Government Inspectorate and 3 Penal Judgments of Appeal related to land. Typically, 13 projects in Son Tra peninsula have not completed procedures and 1,313 cases of granting land use right certificates are not suitable.
The reasons for this situation are due to long-term existence, involving many entities, changes in legal policies, lack of specific regulations or regulations that are not suitable for practice, errors of state management agencies, and project transfers through many investors. Handling these problems is difficult and can lead to complaints, affecting security, order and the rights of people and businesses.
Mr. Le Trung Chinh - Chairman of the People's Committee of Da Nang City - informed that this locality is actively implementing Conclusion 77/2024 of the Politburo and Resolution 170 of the National Assembly to remove difficulties for projects and land that are stuck in inspection, examination and judgment conclusions. Of which, the work of reviewing and recording the original documents has been implemented by Da Nang City to about 90% and is expected to be completed in April.
According to the People's Committee of Da Nang City, on May 2, 2024, the Politburo issued Conclusion No. 77-KL/TW on the Project to remove difficulties related to projects and land. On November 30, 2024, the National Assembly passed Resolution No. 170/2024/QH15 stipulating a special mechanism for Ho Chi Minh City, Da Nang and Khanh Hoa, effective from April 1, 2025. This Resolution clearly stipulates the handling of continued land use, determination of land prices, calculation of land use fees and land rents in Da Nang.
Regarding the re-determination of land prices to collect financial obligations, the People's Committee of Da Nang City has agreed on 3/11 reports on the collection plan and directed the Department of Agriculture and Environment of Da Nang City (Department of Natural Resources and Environment) to report to the State Audit according to the process. In particular, the Department of Finance has hired a consulting unit to re-determinate land prices for 8/15 real estate facilities according to Inspection Conclusion No. 34. The results of determining land prices have been available and are preparing for further implementation steps.
Da Nang is also stepping up handling of projects violating the law on Son Tra peninsula, with the review of 15 projects and the cancellation of boundary diagrams for 5 projects that have not yet been allocated land.

For projects on Son Tra peninsula, the City People's Committee is focusing on handling projects that do not meet the conditions, violate the law on land, investment, construction, forest protection management and national defense and security. The Department of Construction is seeking opinions from units to submit to the City People's Committee to cancel the boundary diagram of 5 projects that have not yet been allocated land. The Department of Natural Resources and Environment is reviewing the remaining 15 projects' legal documents and providing information to relevant departments and branches for inspection.
In addition, the City People's Committee is also implementing steps to implement Judgment No. 346 related to the 3,264m2 land plot on Ngo Quyen Street, expected to adjust the zoning plan from the land of "Kindergarten" to "Trade and Service" in March. For the gheng Ban - Bai Da Eco-tourism Project, luxury villas and Suoi Da Villa Project - Lot L09, the Department of Natural Resources and Environment is reviewing all procedures for land allocation, land lease, and issuance of land use right certificates and will report to the proposal in March.
Regarding the collection of exemptions and reductions of 5%, 10% of land use fees, the City People's Committee has issued 113 decisions to recover out of a total of 254 cases and is reviewing 96 other draft decisions. The Department of Natural Resources and Environment is also reviewing 39 petitions from secondary investors who do not agree to pay arising financial obligations according to the inspection conclusion.
The City People's Committee has reported to the Party Committee of the Government, Government and Prime Minister on the procedures for reclaiming the 181ha project in February. Regarding the Chi Lang Stadium Commercial and Service Complex Project, the City People's Committee has consulted the Ministry of Construction and will continue to implement the next steps.
