The Ministry of Construction drafted a Decree amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing.
In the draft, the Ministry of Construction proposed to amend the regulations on income conditions for purchasing and renting social housing as prescribed in Clause 1, Article 30 of Decree No. 100/2024/ND-CP in the direction of: Increasing income conditions for unmarried or divorced people who have not remarried or confirmed to be single, the average monthly income actually received shall not exceed 20 million VND; in case the person in the position of a petitioner is married, the person in the position of a petitioner and his/her (husband) with a total monthly average income actually received shall not exceed 40 million VND calculated according to the Salary and Salary Table.
In case the subject is unmarried or divorced but not remarried or confirmed as single and raising a child under the age of majority, the average income shall not exceed 30 million VND calculated according to the Salary Table, salary confirmed by the agency, unit or enterprise where the subject works.
The time to determine the income condition is within 12 consecutive months, from the time the subject submits a valid application to the investor to register to buy or rent social housing.
The Ministry of Construction also proposed to amend the regulations on interest rates for loans for purchasing and leasing social housing through the Social Policy Bank as prescribed in Clause 4, Article 48 of Decree No. 100/2024/ND-CP in the direction of studying the reduction of preferential loan interest rates for purchasing and leasing social housing (5.4%/year).
It is known that the current regulations in Clause 1, Article 30 of Decree No. 100/2024/ND-CP on income conditions for the purchase and rental of social housing for subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law are as follows:
In case the petitioner is a single person, with actual monthly income, the salary is not more than 15 million VND calculated according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
In case the plaintiff is married according to the provisions of law, the plaintiff and his/her wife (husband) with a total monthly income shall receive no more than 30 million VND in equity according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
The time to determine income conditions is for 01 consecutive year, starting from the time the subject specified in this clause submits a valid dossier to the investor to register to buy or rent-purchase social housing.
