5 types of land with a term of use of 50 years
Pursuant to Point a, Clause 1, Article 172 of the 2024 Land Law, individuals directly engaged in agricultural production are allocated land and recognized for agricultural land use rights with a term of use of 50 years, including:
1. Land for growing annual crops.
2. Aquaculture land.
3. Land for salt production.
4. Land for growing perennial crops.
5. Production forest land is planted forest within the limit
- How to handle when the term of use expires: For land with a term of use of 50 years when the term of use expires if the individual directly engaged in agricultural production has a need, it can continue to be used for a term of 50 years.
Land with a term of use of no more than 50 years
According to Point b, Point c, Clause 1, Article 172 of the 2024 Land Law, land with a term of use of no more than 50 years includes 02 groups: Agricultural land leased by individuals and land allocated or leased by the State under a project or application for land allocation or land lease, specifically:
(1) Individuals leasing agricultural land with a lease term of not more than 50 years. When the land lease term expires, if there is a need, the State will consider continuing to lease.
According to Clause 2, Article 9 of the 2024 Land Law, agricultural land includes the following types of land:
- Land for growing annual crops, including rice land and land for growing other annual crops.
- Land for perennial crops.
- Forestry land, including special-use forest land, protective forest land, and production forest land.
- Aquaculture land.
- Concentrated livestock land.
- Salt soil.
- Other agricultural land.
(2) Organizations that are allocated land or leased land to implement investment projects using land are considered and decided according to the investment project's operating period or the application for land allocation or lease.
(3) For projects with an operating term of over 50 years as prescribed by the Investment Law 2020, the term of land allocation and land lease shall be according to the project term but not exceeding 70 years.
When the term expires, if the land user has a need to continue using the land, the State will consider extending the land use term but not exceeding the term prescribed above.
In case the investment project is not required, the land use term will be considered based on the application for land allocation or land lease, but not exceeding 50 years.
