Khanh Hoa Provincial Inspectorate has just concluded a specialized inspection of the management of 5% public land and other types of land in Phuoc Dong commune (Nha Trang), thereby discovering many shortcomings in management.
In 1998, the People's Committee of Phuoc Dong commune developed a plan to implement Decree 64/CP (referred to as Plan 64), setting up a public land fund according to the local adjustment method. Areas with an average land area divided by household size higher than the average of the whole commune will be reduced to put into the public land fund.
There are about 10.5 hectares of public land fund of the commune (no list of land plots) approved by Nha Trang City People's Committee on the plan of the same year.
Up to now, the total number of public land plots of the commune is 145 plots, with an area of more than 14 hectares; Phuoc Dong commune does not carry out the exchange of public land.
As a result of inspecting 19/129 random land plots according to plan 64, the Inspectorate found that 11 land plots were managed and used by local people, some of which had houses and construction works built on them; 7 plots were managed by the Commune People's Committee but are currently being encroached upon and illegally used; 1 plot was partly managed by the Commune People's Committee and partly used by local people (plot 43, sheet 28).
The total number of public land plots encroached and illegally used in the commune is 99 plots with an area of 10.6 hectares.
Evidence such as land plot 109, map sheet 47 (according to the 1996 map, plots 415, 416, sheet 22) according to the report of the Department of Natural Resources and Environment, Phuoc Dong Commune People's Committee is public land but has been granted a land use right certificate to the people by Nha Trang City People's Committee.
Or like land plot 43, map sheet 28, which has been illegally encroached upon and used by households since 2005 until now, but there have been no measures to handle it...
According to the inspection agency, the encroachment and illegal use of public land in Phuoc Dong commune has been happening for a long time, over many periods, but has not been completely handled.
The current situation is complicated, many public lands have been encroached upon by people to build solid houses.
Furthermore, the statistics and inventory of data are still lacking in rigor. Phuoc Dong commune has not yet determined the specific and exact quantity and total area of public land plots that the commune is managing.
