Speaking with Lao Dong, Ms. Doan Thi Thanh My - Deputy Director of the Department of Land Management (Ministry of Agriculture and Environment) said that in the administrative procedure issued with Decree No. 101, one of the important decrees detailing and guiding the implementation of the Land Law, the order and procedures related to registration and issuance of Land Use Rights Certificates have been clearly regulated.
Currently, according to the new decentralized orientation, authority and place of settlement for the first land use right certificate to households and individuals transferred to the commune level. The process is still the same, but the authority and the place of settlement are the commune level.
According to Ms. My, in the provisions of the current Land Law, when people register to be granted a Certificate of Land Use Rights for the first time, in some cases, people must have confirmation from the People's Committee at the commune level on some contents such as: Stable land use; Land without disputes; Land use in accordance with planning...
Currently, with the decentralization of the commune level, people no longer have to do the above things that the commune will do. According to the Deputy Director of the Land Administration Department, this brings many practical benefits such as shortening the time for handling administrative procedures, shortening the number of steps to carry out the procedures and not requiring people to prepare certified documents that the commune will do.
Sharing with Lao Dong, Dr. Pham Anh Tuan - Head of the Department of Land Management, Hanoi University of Natural Resources and Environment said that the draft Decree of decentralizing many powers to the commune level has brought many positive impacts such as the shortened administrative apparatus, the land administrative procedures are thoroughly reformed in a beneficial direction for people and businesses. Reduce requirements for report forms, quantity, document components, shorten appraisal time and flexible application submission methods to facilitate people and businesses in carrying out land administrative procedures, reduce unnecessary administrative procedures and do not create new administrative procedures in the land sector.
For the expected commune level will be the place to issue a red book for the first time, Mr. Tuan said that this is very favorable. For example, before that when implementing the three -level government, when granting the certificate, it was necessary to verify whether the land was disputed or not, but when it was assigned to the commune authorities, those procedures were naturally ignored and convenient for the people.
According to Mr. Tuan, currently, when the administrative processes and procedures on land under the authority of the district level are basically transferred to the commune level or the change of administrative boundaries at all levels after the merger or change of place names will also need time to be completed.
