The Ministry of Justice has just announced the Appraisal file of the draft Decree of the Government on the construction and management of information systems and databases on housing and real estate markets.
According to the Ministry of Construction - the drafting agency, on July 24, 2024, the Government issued Decree No. 94/2024/ND-CP detailing a number of articles of the Law on Real Estate Business on the construction and management of the Information System, database on housing and real estate market.
To implement this Decree, the Ministry of Construction has presided over and coordinated with ministries, branches and localities to gradually build and operate an information system, organize the collection, updating and synthesis of data to serve the work of directing, operating and reporting to the Government and the Prime Minister quarterly.
However, the implementation practice in the past has revealed many difficulties and inadequacies in terms of legal regulations, implementation organization and technical capacity.
The study of amending and replacing Decree No. 94/2024/ND-CP is an urgent requirement, in order to complete the legal basis in accordance with the context of national digital transformation, ensuring synchronization with new legal regulations on land, housing, real estate business and digital data;
Establish a mechanism for connecting and sharing data unifiedly, creating a legal corridor for integrating the information system on housing and real estate market with the National Database; Improve the efficiency, quality and transparency of data, better serve macro-management and operation and meet the needs of people, businesses and investors for information access.
Notably, Article 18 of the draft stipulates information and data on real estate service business organizations as follows:
1. Information about the Real Estate Exchange includes:
a) Information on organizations and enterprises: Name of the trading floor; tax code; name of the manager and operator; address; Operating status (currently operating, temporarily suspended, terminated);
b) Number of employees; number of employees with real estate brokerage certificates.
2. Information on the organization of real estate brokerage services
a) Information on organizations and enterprises: Brokers' service business organizations; tax codes; management and operation company names; addresses; Operating status (currently operating, temporarily suspended, terminated);
b) Number of employees; number of employees with real estate brokerage certificates.
3. Information on real estate consulting and management service business organizations
a) Information on organizations and enterprises: Name of real estate consulting and management service business organization; tax code; name of management and operation person; address; Operating status (currently operating, temporarily suspended, terminated);
b) Number of employees.
Article 19 stipulates information and data on individuals granted real estate brokerage practice certificates, including:
1. Personal information:
a) Full name;
b) Number of citizen identification card/ID card or personal identification code;
c) Day/month/year of birth.
2. Information on the practice certificate:
a) Certificate number;
b) Day, month, year of granting the certificate;
c) Revoked (if any).
