Decree 151/2025/ND-CP stipulates the division of authority of local authorities at 2 levels, decentralization of authority, and delegation of authority in the land sector. Clause 1, Article 5 of Decree 151/2025/ND-CP stipulates the authority of the People's Committee at the district level according to the provisions of the Land Law and transfers it to the Chairman of the People's Committee at the commune level for implementation, including the specific land price decision as prescribed in Clause 2, Article 91 of the Land Law.
Decree 151 also stipulates that the Chairman of the People's Committee at the commune level is decided to establish a specific land price appraisal council at the commune level.
Speaking to Lao Dong, Dr. Pham Anh Tuan - Head of the Department of Land Management, Hanoi University of Natural Resources and Environment said that currently, all work related to decentralization and delegation of authority - including the assignment to the commune level to decide on specific land prices and the Chairman of the People's Committee at the commune level to participate in the Council for developing local land price lists - has been implemented. This is completely consistent with the model of a near-people government, while the superior government is of a creativity nature. The implementation responsibility is fully assigned to the commune-level government, so deciding on specific land prices taken up by commune-level cadres is completely reasonable.
According to Dr. Pham Anh Tuan, currently, the team of commune-level cadres is mainly mobilized from the district and provincial levels. They have worked in land valuation, have been well-trained in their expertise and only when they meet all standards and criteria can they be selected to join the commune's consulting, management and leadership department. Therefore, it is completely possible to rest assured when the commune is assigned the task of consulting and deciding on specific land prices.
"Therefore, it is completely feasible to advise and decide on specific land prices at the commune level, in order to serve each project when the state conducts land recovery. We do not need to worry too much about assigning specific land valuation authority to the People's Committees at the commune level, because this is in line with the current actual situation" - Mr. Tuan said.
Mr. Mai Van Phan - Deputy Director of the Department of Land Management (Ministry of Agriculture and Environment) said that when assigning many responsibilities to the commune level, localities need to select worthy cadres who dare to do and take responsibility.
At the same time, according to him, in this mechanism and policy, the Central Government and ministries will only issue policies at the macro level, while the rest will strengthen inspection and examination work to ensure the correct implementation of administrative procedures, while monitoring the time to handle procedures and specific responsibilities of each individual during the implementation process.
