Select another consulting unit to re-evaluate the bidding package if necessary
The Ministry of Finance has just reported the results of the inspection of the selection of contractors for the construction package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh expressway project through Binh Phuoc province on July 5.
The Ministry of Finance recommends that the Government leaders direct the People's Committee of Dong Nai province:
Research and absorb the opinions of the Ministry of Finance to review, inspect, and re-evaluate the entire process of contractor selection, overcome the shortcomings and errors that have been pointed out; select another consulting unit with capacity and experience to conduct reviews, inspections, and re-evaluations (if necessary).
After re-evaluating the E-HSDT and making changes to the proposed bidder or all bidding bidders are assessed as not meeting the requirements, the competent person implementing the measure shall not recognize the results of contractor selection as prescribed in Point b, Clause 1, Article 18 of the Law on Bidding; review and handle the organization or individual who violated the law (if any).
On that basis, the investor will carry out the next steps (cance the bidding to reorganize the bidding or re-approve the results of the contractor selection) to ensure compliance with legal regulations on bidding.
In case after re-evaluation without changing the results of contractor selection, the investor needs to quickly complete and sign a contract with the winning contractor.
In all cases, the selected winning contractor must meet the requirements of capacity, experience, technical solutions, finance, quality, and package implementation progress; no loss, waste, or negativity will occur.
The People's Committee of Dong Nai province is fully responsible for the selection of contractors for this package in accordance with the principle of local decisions, local actions, and local responsibilities as directed by Deputy Prime Minister Tran Hong Ha in document No. 4755/VPCP-CN.
If necessary, the People's Committee of Dong Nai province will discuss with the Ministry of Construction and relevant ministries and branches to determine the necessity, legality, and legality of technical safety and environmental protection inspection documents or inspection certificates according to regulations for mainly construction machinery and equipment in the package.
Resolve the petition of Son Hai contractor in compliance with legal regulations, objectively, and avoid prolonged petitions.
Pointing out some points that are not transparent and clear
The report of the Ministry of Finance pointed out some areas that were not transparent and clear in the package proposed by Son Hai Group. Typical examples are as follows:
Regarding the application of BIM - The project information model in the bidding package, the Ministry of Finance concluded that the bidding documents did not ensure transparency and clarity in the criteria for evaluating BIM work, which could lead to different understandings of contractors, causing difficulties in proposing the application of BIM in E-HSMT.
The fact that the Expert Team only relies on general criteria to evaluate BIM work proposals of contractors can lead to subjective assessments.
Regarding construction machinery and equipment for the construction of the package. E-HSMT included the assessment standard of "motorbikes equipped with equipment that must ensure technical safety and environmental protection inspection or have an inspection certificate according to current regulations" in the capacity, experience and technical assessment section, leading to inconsistency between the assessment content and assessment methods.
Regarding the capacity of the Expert Team, the Ministry of Finance concluded that the Expert Team and the investor are responsible for considering carefully in deciding to continue using this Expert Team or choose another consulting unit to re-evaluate the E-HSDT of the contractors, ensuring objectivity and fairness.
Regarding this package, Lao Dong Newspaper previously reported that Son Hai Group had a document protesting the results of the selection of contractors to build the Ho Chi Minh City - Thu Dau Mot - Chon Thanh expressway. This enterprise is one of 4 contractors participating in the bidding and was rejected. This company believes that even though the unit has the lowest and most economical bidding, it is not selected. Choosing a business to bid higher can cause waste and loss of state assets.
Son Hai Group proposed many contents for bidding on the bidding documents of this enterprise. At the same time, it is recommended to re-dated the bidding package.
