On November 10, 2025, the Minister of Construction issued Circular 32/2025/TT-BXD amending and supplementing a number of articles of Circular 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the 2023 Housing Law.
(1) Scope of amendment of Circular 32/2025/TT-BXD amending and supplementing a number of articles of Circular 05/2024/TT-BXD is specifically as follows:
- Documents proving the subject and conditions for enjoying social housing policies (Article 6, Article 8 of Circular 05/2024/TT-BXD).
- Model in Appendices I and II of Circular 05/2024/TT-BXD.
- How to determine the cost by experts and confirmation agencies.
(2) Changes in subjects and models of documents proving (Article 6 of Circular 05/2024/TT-BXD)
Previously, according to Circular 05/2024/TT-BXD, subjects in Clauses 5, 6, 8, 9, 10 and 11, Article 76 of the 2023 Housing Law all used Form No. 01 to prove that they are eligible for social housing policies.
However, Circular 32/2025/TT-BXD has adjusted and clearly separated the group of subjects and applicable models. Specifically, Form No. 01 is used for subjects specified in Clauses 9, 10, 11 and Clause 5, Article 76 of the 2023 Housing Law (in case of no labor contract, no pension). At the same time, Circular 32/2025/TT-BXD adds Form No. 01a, applicable to subjects in Clauses 5, 6 and 8, Article 76 of the Housing Law 2023, except for the above-mentioned Clause 5.
(3) Amending regulations on proving income conditions (Article 8 of Circular 05/2024/TT-BXD)
Previously, according to Circular 05/2024/TT-BXD, the proving of income conditions was carried out through Form No. 04 or Form No. 05, depending on whether the dossier maker had or not a labor contract.
In Circular 32/2025/TT-BXD, this regulation is amended more clearly on the subjects of application for each model. Specifically:
Form No. 01a in Appendix I issued with this Circular, applies to subjects specified in Clauses 5, 6, 8, Article 76 of the Housing Law 2023, except for subjects specified in Clause 5, Article 76 of the Housing Law 2023 who do not have labor contracts and are not entitled to pension paid by the Social Insurance agency.
Form No. 04 in Appendix I issued with this Circular, applies to the subjects specified in Clause 7, Article 76 of the Housing Law 2023.
Form No. 05 in Appendix I issued with this Circular, applies to subjects specified in Clause 5, Article 76 of the 2023 Housing Law who do not have a labor contract and are not entitled to pension paid by the Social Insurance agency.
In case the person applying for or renting social housing is married, the wife or husband of that person must also declare a form of documents proving income conditions according to Form No. 01a or Form No. 04 or Form No. 05 in Appendix I issued with this Circular.
In addition, Circular 32/2025/TT-BXD adds Clause 2a, stipulating that in case a retiree is receiving a pension, the Social Insurance agency or the People's Committee at the commune level has the authority to confirm according to Form No. 01a.
A notable new point is that the scope of confirmation by competent authorities has been expanded, not only limited to working units as before but also including the Social Insurance agency and the People's Committee at the commune level, creating more favorable conditions for people in the process of completing documents.
