On May 7, 2018, the Department of Construction sent a document to Hanoi Housing Management and Development Company Limited with the content "Recovering the entire area of service business being rented without the approval of the City People's Committee, reporting to the Department of Finance to organize a rental rights auction according to regulations. Reclaim the areas of parking lots and other areas that are self-converted to service business areas, report to the Department of Construction before May 30, 2018".
Hanoi Housing Management and Development Company Limited then sent documents to the lessee, requesting the return of the area; sent to Kim Chung Commune People's Committee, Dong Anh District People's Committee to request coordination with the company to propagate and mobilize the lessee to return the area; sent Dong Anh Power Company to request the power cut.
As of September 2022, 25/56 points have been returned by the lessee (Hanoi Housing Management and Development Company Limited has locked and sealed the doors), and 31 points have not been returned by the lessor.
Hanoi Housing Management and Development Company Limited has 31 submissions requesting the Department of Construction to submit to the City People's Committee for revocation. Based on the proposal of Hanoi Housing Management and Development Company Limited, the Department of Construction has advised and reported to the City People's Committee to issue 31 decisions to reclaim 31 points (including 12 service business points according to the design and 19 points transferred from the parking lot and other areas to be rented out for service business).
Implementing 31 revocation decisions of the City People's Committee, Hanoi Housing Management and Development Company Limited has reclaimed 3/31 points (3 points Hanoi Housing Management and Development Company Limited converted to its own function). There are 28 points that have not been recovered.
After the revocation period, the Department of Construction has advised and reported to the City People's Committee to issue 28 decisions to enforce the revocation of state-owned housing areas on the first floor for 28 points that have not been recovered. Dong Anh District People's Committee will carry out the compulsory recovery; hand over to Hanoi Housing Management and Development Company Limited to receive, manage, and arrange for use according to the regulations of the City People's Committee.
After the decision to enforce the recovery was made, 8/28 points of the tenants handed over the area to Hanoi Housing Management and Development Company Limited for management (locked), and 20/28 points must be enforced recovery.
According to the report of the People's Committee of Dong Anh district, on October 2, 2023, the Department of Natural Resources and Environment advised the People's Committee of Dong Anh district to draft a Plan to organize the implementation of the enforcement decision. However, the People's Committee of Dong Anh district has not approved the plan to organize the enforcement. On October 27, 2023, the People's Committee of Dong Anh district issued a document reporting to the People's Committee of the city to extend the decision to enforce the revocation.
On November 30, 2023, the City People's Committee announced the assignment of the Dong Anh District People's Committee to urgently review and develop a plan and organization plan for enforcement according to regulations. Before December 10, 2023, the People's Committee of Dong Anh district is responsible for arranging appropriate facilities to preserve and conserve the assets subject to enforcement according to regulations.
On April 3, 2024, the People's Committee of Dong Anh district has a plan to organize the compulsory recovery of the state-owned housing area on the first floor of the Kim Chung Commune Workers' Housing Area. The enforcement period is 16 days, expected in the second quarter of 2024.
However, according to the Hanoi City Inspectorate, at the time of issuing the conclusion, the organization of enforcement had not yet been carried out.
