Raising the ceiling income for buying social housing
Decree 136/2026/ND-CP amends and supplements Clause 1, Article 30 of Decree No. 100/2024/ND-CP amending the income conditions for purchasing social housing in the direction of increasing the income ceiling from 5-10 million VND/month depending on the subject compared to previous regulations.
Article 30. Conditions on income
1. For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, the following income conditions must be ensured:
a) In case the applicant is a non-married person or is certified as single, the average monthly actual income does not exceed 25 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
In case the applicant is a non-married person or is certified as single and is raising a minor child, the average monthly actual income does not exceed 35 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
b) In case the applicant is married according to the provisions of law, the applicant and their spouse have a total average monthly actual income of no more than 50 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
c) The time to determine income conditions according to the provisions of points a and b of this clause is within 12 consecutive months, calculated from the time the competent authority performs the confirmation.
d) Based on the conditions and income levels of each area in the area, preferential housing policies for cadres, civil servants, public employees, and the number of dependents according to the provisions of law, the Provincial People's Committee is allowed to decide the income level adjustment coefficient specified in points a and b of this clause but not exceeding the ratio between average per capita income in the locality and average per capita income of the whole country; decide on policies to encourage access to social housing for subjects entitled to social housing support policies with 3 or more dependents in the same household.
Housing conditions to be supported with social housing
According to Article 29 of Decree 100/2024/ND-CP (amended and supplemented in Decree 54/2026/ND-CP) stipulating housing conditions as follows:
- In case there is no housing owned by them, it is determined when the subject specified in Clause 1, Article 77 of the 2023 Housing Law and the spouse of that subject (if any) are determined to have no name or no housing information content in the Certificate of land use rights, ownership of assets attached to land in the province or centrally-run city where the social housing project is located.
Within 7 days from the date of receiving the request for confirmation of housing conditions, the competent authority issuing the Certificate of land use rights, ownership of assets attached to land according to the provisions of land law in the province or centrally-run city where there is a social housing project certified according to the provisions of this clause.
- In case the subject specified in Clause 1, Article 77 of the 2023 Housing Law owns a house but the average housing area per capita is less than 15 m2 of floor space/person. The average housing area per capita specified in this clause is determined on the basis of including: the applicant, the spouse of that person, the father, mother (if any) and children of that person (if any) registered permanently residing in that house.
Within 7 days from the date of receiving the application for confirmation of the average housing area per capita, the commune-level People's Committee shall carry out the confirmation for the cases specified in this clause.
