According to Clause 24, Article 3 of the 2024 Land Law, it is stipulated that:
Support when the State reclaims land is a State policy to assist people whose land is reclaimed and owners of assets attached to land to stabilize their lives, production and development in addition to the compensation amounts prescribed in this Law.
At the same time, Clause 1, Article 19 of Decree No. 88/2024/ND-CP regulating compensation, support, and resettlement when the State reclaims land stipulates:
Article 19. Supporting stabilization of life when the State reclaims land
1. Households and individuals using agricultural land that are eligible for land compensation will be supported to stabilize their lives as follows:
a) Recovering from 30% to 70% of the agricultural land area in use will be supported for 6 months if there is no need to relocate and for 12 months if there is a need to relocate; in case of having to move to an area with difficult socio-economic conditions or with particularly difficult socio-economic conditions, the maximum support period will be 24 months.
In case of recovery of over 70% of the agricultural land area in use, support will be provided for 12 months if there is no need to relocate and for 24 months if there is a need to relocate; in case of having to move to an area with difficult socio-economic conditions or with particularly difficult socio-economic conditions, the maximum support period will be 36 months;
b) The area of agricultural land recovered to calculate the support for stabilizing life prescribed in Point a of this Clause is the area within the commune, ward, or town where the land is recovered at the time of the decision approving the compensation, support, and resettlement plan and is determined according to each project that must be recovered by the People's Committee at the competent level, without accumulating the area of agricultural land recovered from previous land recovery projects;
c) The level of support for a person specified in Point a and Point b of this Clause is calculated in cash equivalent to 30 kg of rice in 1 month according to the average price at the time of support of the locality.
