National Highway 6 expansion project: Commune answers about site clearance compensation price

Hanoi - Leaders of Xuan Mai Commune People's Committee have explained to people about the petition that the compensation price is not realistic when land is recovered to expand National Highway 6.

The project to expand National Highway 6, Ba La - Xuan Mai section (Hanoi) has a total length of 21.7 km, of which the section passing through Xuan Mai commune is about 6.53 km long.

According to Xuan Mai Commune People's Committee, the total area of land recovered for project implementation is 38.58 ha with 1,804 land plots, related to about 1,376 households and individuals.

In which, residential land used by households and individuals alone accounts for 917 plots, an area of 8.31 ha; in addition, there are agricultural land, public land, national defense and security land and land of agencies and organizations.

Over the past time, local authorities have received many opinions and recommendations from households and individuals affected by the project to renovate and upgrade National Highway 6, focusing on a number of contents such as: Land compensation price; adjustment coefficient; priority regime for resettlement areas; along with specific issues related to the time of purchase and sale, traffic safety corridor boundary, current land use status through periods.

According to Mr. Trinh Ba Thuong, Vice Chairman of Xuan Mai Commune People's Committee, the government always wants the highest compensation level for people to create consensus and convenience for site clearance work.

However, the application of unit prices must comply with the provisions of law (Land Law 2024, Resolutions of the City People's Council), and cannot arbitrarily raise or lower prices according to subjective will.

The construction of compensation prices is carried out according to a strict process, not subjective. The current legal basis applies the land price list in Resolution 52 of the City People's Council combined with the adjustment coefficient K according to Decision 89/2025.

Explaining the proposal that the compensation price is not close to reality, Mr. Trinh Ba Thuong said: According to Clause 2, Article 1 of Decision 89/2025, if the compensation price is not close to the market price, the Commune People's Committee is responsible for considering and summarizing reports to the Department of Agriculture and Environment to submit to the City for adjustment.

However, "market price" must be the legal, successful transaction price and controlled by the tax authority (based on the tax notice upon transfer). Handwritten transactions or declarations lower than reality do not have sufficient legal basis to serve as a basis for price adjustment.

According to Mr. Thuong, currently, the K coefficient is determined by 1, uniformly applied throughout the City. Market prices are based on legal and successful transactions controlled by tax authorities.

The government acknowledged the opinion that the actual price may be higher than the notarized price, but the adjustment of the K coefficient must have a process of reporting to the Department of Agriculture and Environment and submitting it to the City People's Committee for approval.

Leaders of Xuan Mai Commune People's Committee emphasized the consistent viewpoint of "applying policies within the highest scope, in accordance with legal regulations to ensure the legitimate rights of the people".

Local authorities also affirmed their willingness to meet and directly dialogue with each household to provide specific answers, help people understand and agree with the policy of land acquisition and site clearance for the National Highway 6 expansion project.
