Pursuant to Article 99 of the 2014 Construction Law, the extension of construction permits is regulated as follows:
Article 99. Extension of construction permit
1. Before the construction permit expires, if the project has not been started, the investor must request an extension of the construction permit. Each construction permit can only be extended up to 2 times. Each extension period is 12 months. When the construction permit extension period expires but construction has not yet started, the investor must submit a dossier to request a new construction permit.
2. The application for a construction permit extension includes:
a) Application for extension of construction permit;
b) The original construction permit has been issued.
3. For works and individual houses with a construction permit that has expired and is stated in the permit, but the planning has not been implemented, the project owner or the person assigned to use the project shall request the construction permit issuing agency to consider extending the existance period until the planning is implemented. The duration of the project is recorded immediately in the issued construction permit with a term.
Accordingly, the construction permit can only be extended by a maximum of 2 times and each extension is 12 months. In addition, when the extension period expires but the construction has not yet started, the investor must submit a dossier to request a new license.
The application for a construction permit extension must include the following documents:
(1) Application for extension of construction permit;
(2) The original construction permit has been issued.
For works or individual houses that have been granted a construction permit for a period of time, if that period has expired but the area has not yet been planned, the owner or the person currently using the works can submit a request to the competent authority to extend the life of the works. The extended period will be recorded directly in the previously granted construction permit.
