Vice Chairman of Hanoi People's Committee Nguyen Trong Dong has just signed a decision to adjust some contents and part of the area stated in Decision No. 3700 dated December 28, 2006 of Vinh Phuc Provincial People's Committee on land allocation for the construction project of Minh Giang - Dam Va Residential Area in Tien Phong Commune, Me Linh District.
Accordingly, adjust land allocation to Minh Giang Investment and Trading Joint Stock Company to implement the Minh Giang - Dam Va Residential Area project (phase 1).
Handing over nearly 26.2 hectares of land (phase 1) in Tien Phong commune, Me Linh district, completing site clearance for Minh Giang Company to implement the Minh Giang - Dam Va Residential Area project (phase 1).
Of which, there are 101,196m2 of residential land; 8,409m2 of public land for business purposes; 119,635m2 of traffic and green land; 32,747m2 of commercial land (including: market land, green land, primary school, parking lot...).
Hanoi People's Committee requested Minh Giang Company to contact the Department of Natural Resources and Environment to review and re-determine land use fees and land rental fees (because the actual land handover time is different from the time of land handover decision according to regulations).
At the same time, determine additional land use fees for the increased residential land area (3,729m2); collect late payment fees (if any) and determine additional financial obligations due to planning adjustments. In addition, it is necessary to review the payment of fees for protection and development of rice-growing land according to the provisions of law (if any); carry out procedures for land lease contracts according to regulations.
Contact the Hanoi Tax Department for instructions and payment of land rent and other outstanding financial obligations (if any) as prescribed.
Coordinate with the People's Committee of Me Linh district to complete the site clearance for the remaining area of 555.8m2 in the first quarter of 2025. Then complete the report to the City People's Committee to adjust the land allocation decision (phase 2) for the remaining area of 2,594.9m2 according to regulations.
In case of non-use of land for 12 consecutive months or the land use progress is 24 months behind the progress recorded in the investment project from the date of receiving land handover on site, Minh Giang Company is granted a 24-month extension of land use and must pay the State an amount of money corresponding to the land use fee and land rent for the period of delay in project implementation during this period.
If Minh Giang Company has not put the land into use after the extended period, the State shall reclaim the land without compensation for the land and assets attached to the land, except in cases of force majeure.
