Accordingly, in the document sent to departments, branches, districts, towns and cities regarding land use rights auctions, Hanoi City directed units to continue to improve regulations, including limiting the organization of auctions to allocate land to individuals for self-construction of houses.
The document also gives priority to land auctions with land use fees and land leases for organizations to implement investment projects. This is to ensure the selection of investors with sufficient capacity to implement the project, contributing to improving land use efficiency.
In fact, recent land auctions in the suburbs of Hanoi have somewhat raised public suspicions about the irregularities when many plots of land were successfully auctioned at very high prices, over 100 million VND/m2.
It is worth mentioning that after winning the auction, many of the winning bidders did not come to pay the auction fee even after the stipulated time. The plots of land that had been successfully sold before are still vacant fields, with no buyers building houses on them.
In the above document, Hanoi also requested the People's Committees at the district level to compile a list of cases where they paid higher than the market price to win the auction but did not pay. This list will then be made public on the information pages of the districts and the Department of Natural Resources and Environment.
The Department of Natural Resources and Environment is required to speed up the progress of updating and adjusting the land price list. In addition, this agency must also promptly coordinate and guide districts to remove difficulties and obstacles in the process of determining land prices.
Hanoi also requested the City Police to consider professional measures to promptly detect violations in the auction of land use rights; guide the People's Committees of districts, towns and cities to take measures to prevent violations of auction regulations from continuing to participate in auctions.
Propose solutions to prevent or restrict continued participation in auctions for those who have participated in auctions, paid "unusually" high prices to win auctions but did not pay the auction winning price as prescribed.
The Hanoi People's Committee also noted that land auction organizers should consider regulating the price steps and auction forms (mandatory multi-round auctions) to ensure competitiveness and closeness to market prices.
In a recent report to the Government, the Ministry of Construction also said that besides the benefits, land auction activities also revealed some limitations and negative aspects such as in some places there is the phenomenon of "auction brokers" colluding, affecting the rights of participants.
The Ministry of Construction believes that there is a phenomenon of paying very high prices for some lots and then canceling the deposit, creating a virtual price level to manipulate the market. Or the buying and selling of many lots of land for illegal profit is more common, even organized.
After the fluctuations, many districts such as Ha Dong, Hoai Duc, Thanh Oai, and Dan Phuong have also proactively stopped some land auctions to review the process and procedures in accordance with legal regulations.
