Handling many violations
On December 28, Soc Son Commune People's Committee said that after implementing the two-level local government model, from July 1, 2025 to now, Soc Son Commune People's Committee has thoroughly grasped and seriously implemented the directions of the Standing Committee of the Commune Party Committee on strengthening land management and construction order in the area.
The Commune People's Committee has issued many directing documents to strengthen state management of land, strictly control construction order violations; and at the same time build information focal points and violation handling procedures. Thereby, contributing to improving the effectiveness and efficiency of state management in the field of land and construction order.
Head of Soc Son Commune Economic Department Trinh Van Duy said that from July 1, 2025 to now, through inspection of the area, functional forces have discovered 28 cases of land and construction order violations.
Up to now, all 28 cases have been handled by local functional agencies, including mobilizing households to self-repair and organizing coercion according to regulations.

Also in recent months, the functional forces of Soc Son commune have organized many campaigns, clearing hundreds of violating works on roads in the area. Before proceeding with handling, the Commune People's Committee promoted propaganda and mobilized people to voluntarily dismantle in order to minimize damage.
Statistics to date, Soc Son commune functional forces have seized hundreds of signs and billboards violating the traffic safety corridor; cleared more than 200 works including platforms, slope roofs, temporary shacks; and at the same time collected all soil, garbage, and scrap gathered along the road, affecting traffic safety, restoring the original state and urban landscape.
Chairman of Soc Son Commune People's Committee Pham Quang Ngoc said that in order to tighten discipline and improve the effectiveness of state management, immediately after operating the two-level local government model, the Commune People's Committee focused on reviewing and comprehensively assessing the situation of land management and construction order; and at the same time issued many directing documents and established coordination mechanisms between specialized departments.
Based on the results achieved in the past period, in the coming time, Soc Son Commune People's Committee will continue to direct the Economic Department to preside over and coordinate with relevant units to regularly maintain inspection and supervision, promptly detect and strictly handle violations right from the time they arise, not allowing prolonged violations to form.
In addition, the Commune People's Committee will continue to classify and develop a handling roadmap for specific and complex cases, associated with the legitimate rights to housing of people. In the process of handling, the locality prioritizes mobilization and propaganda, creating consensus for people to voluntarily comply.
Violations need to be strictly handled
Talking to Lao Dong Newspaper, Dr. Lawyer Dang Van Cuong - Head of Chinh Phap Law Office, Hanoi Bar Association, said that according to the provisions of land law, land use must be for the right purpose, ensuring efficiency. Land law strictly prohibits acts of using land for wrong purposes, destroying land or not complying with regulations on land policies.
According to Lawyer Dang Van Cuong, in the process of urbanization, along with changes in land use planning and plans in localities, many localities have allowed violations of construction order and land use violations, such as illegal construction on agricultural land.
However, the change of land use purpose must be consistent with the land use plan and must fully implement administrative procedures according to the regulations of the competent authority.
In cases where households, individuals or organizations arbitrarily change land use purposes, that is, use land for wrong purposes, violate construction order, depending on the nature and severity of the violation, the violator may be administratively sanctioned or prosecuted for criminal liability for the crime of violating regulations on land use.
Pond and lake land, rice land that people arbitrarily fill to build houses, even subdivide, sell plots and use as residential land are quite common violations in large cities like Hanoi, especially in suburban areas. Cases of encroachment, illegal land use or land use for wrong purposes may be administratively sanctioned or forced dismantled," Lawyer Dang Van Cuong said.
Also according to the Head of Chinh Phap Law Office, for the above-mentioned violations, the involvement of functional agencies is needed through inspection and examination, making violation records and issuing sanctioning decisions.
In case the violator intentionally does not comply with the penalty decision, coercive measures will be applied according to regulations. Notably, if they have been fined or coerced but continue to re-offend, criminal sanctions may be considered.
