The Government has issued Decree 217/2026/ND-CP (effective July 1, 2026) detailing a number of articles of the 2025 Construction Law on construction activity management. In which, Article 61 of this Decree specifically stipulates the dossier for requesting a permit for repair, renovation, and relocation of works. Specifically:
Article 61. Dossier requesting a permit for repair, renovation, and relocation of works
1. Application for a permit to repair, renovate works, and relocate works according to Form No. 01 of Appendix II issued together with this Decree.
2. For cases of repair and renovation, the following components are included:
a) One of the legal land documents for issuing a construction permit as prescribed in Article 55 of this Decree;
b) Current status drawings of parts of works expected to be repaired and renovated that have been approved according to regulations have a ratio corresponding to the ratio of drawings of dossiers requesting repair and renovation permits and photos (minimum size 10 x 15 cm) of the current status of works and adjacent works before repair and renovation;
c) Design documents for repair, renovation, and relocation corresponding to each type of project as prescribed in Article 57 of this Decree.
3. For cases of relocating works including the following components:
a) Copies of documents proving land use rights where the project will be relocated and legal documents on project ownership according to the provisions of law;
b) Construction completion drawing (if any) or design drawing describing the actual condition of the relocated project, including the ground plan, foundation section and main load-bearing structure drawing; overall ground plan drawing of the project location to be relocated; ground plan drawing, foundation section at the project location to be relocated;
c) Report on the results of the survey to assess the current quality of the project performed by a design or inspection organization with functions;
d) Relocation plan implemented by organizations with design or inspection functions includes an explanation of the current status of the project and the area of the project to be relocated; relocation solutions, plans for arranging and using vehicles, equipment, and human resources; solutions to ensure safety for the project, people, machinery, equipment and adjacent works; ensuring environmental sanitation; relocation progress; organizations and individuals implementing project relocation; drawings of construction measures for project relocation.
