On the Government Portal, Mr. N.T.N's family in Lam Dong said that his family is having difficulty in merging adjacent plots of land with different land use terms.
Plot No. 10, map sheet No. 5, land use term until July 1, 2058, land use purpose: perennial trees; plot No. 11, map sheet No. 5, land use term until July 1, 2024, land use purpose: perennial trees.
Mr. N requested the competent authority to guide his family to carry out the plot consolidation.
The Ministry of Agriculture and Environment responds to this issue as follows:
The content of Mr. N's reflection is a specific case under the authority of the locality and needs to be based on archival records and specific regulations issued by the locality according to its authority to implement the Land Law for consideration and resolution; therefore, the Ministry has no basis to answer.
The Ministry sets out some principles as follows:
Article 220 of the Land Law stipulates the conditions and principles for land plot consolidation. Accordingly, point b, clause 3 stipulates:
In case the plots of land have different land use purposes, land use terms, and land rental payment methods, it must be carried out simultaneously with the procedures for changing land use purposes, adjusting land use terms, and changing land rental payment methods to unify one purpose, one land use term, and one form of land rental payment according to the provisions of law.
In the case of adjusting the land use term of investment projects, it is stipulated in Section III, Part VII, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of local authorities at 02 levels, decentralization and delegation of authority in the land sector.
In case of adjusting other land use term, the Ministry of Agriculture and Environment will review, study and advise competent authorities in the process of drafting legal documents.
