According to Article 21 of Decree 101/2024/ND-CP (this clause has expired since July 1, 2025 as prescribed in Decree 151/2025/ND-CP), the regulations on the agency receiving the application for granting red books are as follows:
Article 21. Receive documents and return results of land registration procedures and assets attached to land
The agency receiving the application and returning the results includes:
a) The One-stop Department according to the regulations of the Provincial People's Committee on receiving documents and returning results of handling administrative procedures at the provincial, district and commune levels;
b) Land registration office;
c) Branch of the Land Registration Office.
Pursuant to the provisions of Clause 8, Article 54 of the Law on Organization of Local Government 2025 (Law No. 72/2025/QH15) stipulates:
The work, administrative procedures, complaints and denunciations (collectively referred to as work and procedures) that local authorities at the district level are handling for individuals, organizations and enterprises, if by July 1, 2025, it has not been completed or has been completed before July 1, 2025 but then related issues arise that need to be resolved, then:
+ The agency receiving the functions, tasks and powers of the local government at the district level; Or the newly formed local government at the commune level after the arrangement, where the work and procedures arise; will be responsible for coordinating with relevant agencies to continue to resolve, ensuring no interruption of work, no impact on the normal operations of society, people and businesses.
+ In case the content of work and procedures are related to 2 or more newly formed commune-level administrative units after the reorganization, or there is complicated content, the Chairman of the Provincial People's Committee, based on the provisions of Point g, Clause 2 and Clause 3, Article 11 of this Law, is responsible for directing the resolution.
+ In case the Government's legal documents regulating decentralization, delegation of authority, and division of authority of local authorities under Clause 1 of this Article have specific regulations on the settlement of the above-mentioned tasks and procedures, they shall comply with the Government's regulations.
Accordingly, if people have submitted documents for granting red books at the district level before the merger but by July 1, 2025 they have not been completed or then related problems arise that need to be resolved, then:
- The agency receiving the functions, tasks, and powers of the district-level local government;
- Newly formed local authorities at the commune level after the arrangement of work spaces and procedures;
The above agencies will be responsible for coordinating with relevant agencies to continue to resolve the issue to ensure that work is not interrupted and the process of issuing red books is not affected.
