delays in planning and appraisal
According to TTCP, the project to adjust the general planning of Nha Trang City by 2040 has an area of about 25,422 hectares, of which Dien Khanh district is about 1,314 hectares.
The goal of the project is to develop Nha Trang City into a national and international beach resort tourism urban area, with an expected population of about 630,000 - 640,000 people by 2030.
The planning also requires ensuring objectivity and transparency in implementation, adjustment of zoning plans, detailed plans, land use planning and legal procedures related to the 42 reviewed projects.
However, the implementation process shows that the Ministry of Construction has appraised the project to adjust the general planning of Nha Trang City 7 months later than the time specified in Article 32 of Decree No. 37 of the Government.
At the same time, Khanh Hoa Provincial People's Committee has prepared a project to adjust 2 years and 6 months later than the deadline prescribed in Decision No. 1456 of 2020 of the Prime Minister.
The conclusion of the JSC also clearly shows that the Ministry of Construction regularly appraises the delay in planning tasks and planning projects.
The People's Committees of localities set up planning tasks and long-term planning projects, not within the prescribed time limit. Notably, in the period of 2015-2019, the Ministry of Construction did not issue a decision to establish an appraisal Council, violating Article 42 of the 2009 Law on Urban Planning.
The Ministry of Construction has not yet properly implemented the process of appraising the conditions for meeting the requirements of the planning consulting organization, and has not closely followed the content of the planning task as well as data on population and land.
For the People's Committee of Khanh Hoa province and related units, the JSC pointed out violations such as slow announcement and disclosure of planning projects as prescribed in Clause 1, Article 53 of the Law on Urban Planning 2009; not yet implementing the marking of planning projects according to Article 57 of this law.
Request to review and handle responsibilities
From the above violations, the Government Inspector General proposed the Prime Minister to direct the Ministry of Construction to review and clarify the collective and individual responsibilities of the Ministry's leaders in the occurrence of shortcomings and limitations in the management and implementation of construction plannings.
In addition, the TTCP proposed Khanh Hoa Provincial People's Committee to review and clarify the responsibilities of the provincial leaders and related individuals to occur the above shortcomings. At the same time, the Ministry of Construction and the People's Committee of Khanh Hoa province must be responsible for handling relevant individuals and units according to their competence.
TTCP emphasized that the delay in planning and appraisal not only affects the progress of urban development but also reduces the effectiveness of state management in the planning and construction sector in Nha Trang City and Khanh Hoa Province.
