On November 15, Mr. Nguyen Hong Ha (residing in Nha Trang City, Khanh Hoa) confirmed that he had received a document from the People's Committee of Khanh Hoa province regarding the auction of assets at the Royal Marina Center project.
The document was signed by Mr. Tran Hoa Nam - Vice Chairman of Khanh Hoa Provincial People's Committee on November 14. Accordingly, Mr. Tran Hoa Nam assigned the Department of Natural Resources and Environment to preside over and coordinate with relevant units to inspect, review and resolve the content of the petition in accordance with the provisions of law and report the results to Khanh Hoa Provincial People's Committee before November 30, 2024.
Super project auctioned but no one interested
According to Mr. Nguyen Hong Ha's proposal, Agribank previously announced that it would auction the debt of Ben Du Thuyen Hotel Joint Stock Company at a price of more than 948 billion VND, nearly 200 billion VND cheaper than the starting price offered at the end of last year.
Agribank announced that it will auction the debt of Marina Hotel Joint Stock Company at the end of October. The above debt has been for sale since 2023 but has not yet found a new owner.
The bank then decided to lower the starting price further to VND948 billion.
Previously, in September 2023, Agribank first announced the sale of the debt with a starting price of VND 1,145 billion. The collateral for the debt of Ben Du Thuyen Hotel is the entire land use rights and auctioned assets attached to the land formed in the future of the project "Royal Marina Center - Area B" in Vinh Hoa urban area, Nha Trang.
The project includes 690 apartments and a 36th-floor penthouse garden, a future construction project. Area A of the Royal Marina Center project with an area of nearly 6,000 square meters was also foreclosed and liquidated by another bank to recover the 540 billion VND debt of Marina Hotel.
There is a lawsuit so the auction should be stopped.
According to Mr. Nguyen Hong Ha, there are currently about 20 lawsuits from customers sent to the Nha Trang City People's Court awaiting adjudication. Meanwhile, the organization of asset sales but disputes over apartment purchase contracts between customers and project investors have not yet had a legally effective judgment.
Mr. Nguyen Hong Ha said that the auction of the right to use 5,965 square meters of land and future assets attached to the land in Area A, block number 8 will seriously affect the rights and legitimate interests of individuals and organizations that have purchased apartments in the project.
In addition, Khanh Hoa province has requested many projects with the type of "residential land not forming residential units" to urgently adjust the type of residential land forming residential units.
Therefore, Mr. Nguyen Hong Ha requested Khanh Hoa province to inspect the Royal Marina Center Project which has adjusted the land from non-residential residential land to commercial service land. Is the bank and Thuan Phat Joint Stock Auction Company, the auctioneers of land use rights of the Royal Marina Center Project in Nha Trang City as mentioned above, in accordance with the law?
To avoid complicated legal consequences arising from the above auction, Mr. Nguyen Hong Ha requested the People's Committee of Khanh Hoa province to direct agencies to stop procedures related to the organization of auctions, registration of land use rights, and ownership of auctioned assets related to "residential land not forming residential units" that are being disputed in court.
