New red book model from 2025
Red book (or pink book) is the common name to refer to the official name of the Certificate of land use rights and ownership of assets attached to land issued under the 2024 Land Law.
According to Circular 10/2024/TT-BTNMT, the red book form issued from January 1, 2025 will follow the new form.
Accordingly, this new red book form will include 1 sheet with 2 pages, printed with bronze drum pattern, lotus pink color, size 210 mm x 297 mm, with the National Emblem, National Name, the words "Certificate of land use rights, ownership of assets attached to land", Certificate issuance number (serial number) consisting of 2 Vietnamese letters and 8 digits, the words "Detailed information is shown in the QR code", the number entered in the Certificate issuance book and notes for the person granted the Certificate (called the Certificate blank).
When do I have to re-apply for a new red book from 2025?
If the land user falls into the following cases, he/she must apply for a new red book from 2025:
Case 1: Belongs to the cases of exchange
According to Clause 1, Article 38 of Decree 101/2024/ND-CP, cases requiring red book exchange include:
- Land users who need to change the Certificate issued before August 1, 2024 to a Certificate of land use rights and ownership of assets attached to land;
- The issued certificate is stained, blurred, torn or damaged;
- The certificate has been issued for many land plots but is issued separately for each land plot according to the needs of the land user and in the case of re-issuance of the Certificate of land use rights and ownership of assets attached to land as prescribed in Clause 7, Article 46 of Decree 101/2024/ND-CP;
- The purpose of land use stated on the issued Certificate according to the provisions of the law on land at the time of issuance of the issued Certificate is different from the purpose of land use according to the land classification prescribed in Article 9 of the 2024 Land Law and the provisions of the Government's Decree detailing the implementation of a number of articles of the 2024 Land Law;
- The location of the land plot on the issued Certificate is incorrect compared to the actual location of land use at the time of issuance of the issued Certificate;
- Land use rights and property ownership rights attached to land are the common property of husband and wife, but the issued Certificate only records the full name of the wife or husband. Now there is a request to reissue the Certificate of land use rights and property ownership rights attached to land to record both the full name of the wife and the full name of the husband;
- The issued certificate records the name of the household. Now, members who share the land use rights of that household request to issue a new Certificate of land use rights and ownership of assets attached to the land to record the full names of members who share the land use rights of the household;
- Change the address of the land plot that has been granted a Certificate;
- Changing the size of edges, area, and land plot number due to cadastral mapping and cadastral measurement of the land plot without changing the land plot boundary.
Case 2: Re-issue a new red book because the previously issued one has been lost.
The time for reissuing a red book issued due to loss is no more than 10 working days, not including the time for posting the notice of loss of the issued Certificate at the People's Committee at the commune level, the time for posting the news on the mass media (based on Clause 5, Article 22 and Article 39 of Decree 101/2024/ND-CP).
