Answering the petition transferred by the Committee for Petitions and Supervision according to Official Dispatch No. 2517/UBDNGS15 dated January 16, 2026, the Ministry of Construction said that urgent and urgent construction works are regulated in Article 70 of the Construction Law No. 135/2025/QH15.
According to point a, clause 2, Article 43 of this law, urgent and urgent works are eligible for exemption from construction permits.
Regarding the proposal to specify the list of works such as fences and landslide protection embankments that are exempt from construction permits in urban areas and integrate them into the decree guiding the implementation of the Construction Law No. 135/2025/QH15, the Ministry of Construction said that it is currently studying and drafting a Decree detailing the implementation of the law.
In the process of drafting and absorbing the opinions of the National Assembly Delegation of Cao Bang province, the Ministry will study specific regulations on the process and order of implementing investment in urgent and urgent construction projects as a basis for implementation.
According to the Ministry of Construction, this decree is expected to be promulgated and take effect from July 1, 2026, in line with the effective date of Construction Law No. 135/2025/QH15.
