On July 25, the Department of Construction of Khanh Hoa province announced that it had just issued a plan for surprise and periodic inspections of organizations and individuals trading in real estate trading floors and real estate brokers.
According to the Department of Construction, organizations and individuals providing real estate trading floor and brokerage services but do not fully meet the conditions under the 2023 Real Estate Business Law and Decree 96/2024/ND-CP will have to temporarily suspend operations.
Specifically, enterprises that have not established or registered to operate real estate trading floors in accordance with regulations; do not meet the operating conditions of the Law on Real Estate Business 2023; Decree 96/2024/ND-CP, are not allowed to do business.
In case of intentional illegal activities, they will be strictly handled.
The Department of Construction recommends that units that are qualified to operate declare information online on the website of this department.
The list of eligible exchanges will be publicly announced on the electronic information portal of the Provincial People's Committee and the Department of Construction.
For individuals practicing brokerage, they are only allowed to practice when they have a valid real estate brokerage certificate and work at a business providing exchange services or real estate brokerage services.
Individuals with a practice certificate must declare information on the website of the Department of Construction.
In addition, the Department of Construction will coordinate with the Department of Science and Technology and relevant agencies to inspect and strictly handle the act of using a practice certificate that is not in accordance with regulations or practicing when the certificate has expired.
The list of violations will be publicly announced on the electronic information page.
To avoid the situation where unqualified brokers post unofficial information that negatively affects the market, legal practitioners must clearly state their practice certificate numbers when posting on online platforms such as Zalo, Facebook, etc.
