The Ministry of Agriculture and Environment has just issued a consolidated document 83/VBHN-BNNMT on basic land investigation; registration, issuance of Certificates of land use rights, ownership of assets attached to land and the Land Information System.
The merged document 83/VBHN-BNNMT in 2025 is consolidated from the following 3 Decrees: Decree 101/2024/ND-CP regulating basic land investigation; registration, issuance of Certificates of land use rights, ownership of assets attached to land and the Land Information System, effective from August 1, 2024, amended and supplemented by:
- Decree 151/2025/ND-CP stipulates the division of authority of local authorities at 02 levels, decentralization of authority, and delegation of authority in the land sector;
- Decree 226/2025/ND-CP amending and supplementing a number of articles of decrees detailing the implementation of the 2024 Land Law;
This Decree stipulates in detail and guides the implementation of the Land Law on basic land investigation; registration, issuance of Certificates of land use rights, ownership of assets attached to land and the National Land Information System, including: Clause 4, Article 50, Clause 1, Article 55, Clause 5, Article 131, Clause 7, Article 135, Clause 10, Article 138, Clause 6, Article 139, Clause 7, Article 140, Clause 3, Article 142, Clause 4, Article 170, Clause 2, Article 181 and Points b, c, d, i and k, Clause 1, Article 223 of the Land Law.
The registration of mortgages for land use rights and assets attached to land is carried out in accordance with the provisions of law on registration of security measures.
This Decree takes effect from August 1, 2024. The following Decrees shall expire from the effective date of this Decree:
a) Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government detailing the implementation of a number of articles of the Land Law;
b) Decree No. 01/2017/ND-CP dated January 6, 2017 of the Government amending and supplementing a number of decrees detailing the implementation of the Land Law;
c) Decree No. 148/2020/ND-CP dated December 18, 2020 of the Government amending and supplementing a number of decrees detailing the implementation of the Land Law;
d) Decree No. 10/2023/ND-CP dated April 3, 2023 of the Government amends and supplements a number of decrees detailing the implementation of the Land Law.
Abolish some articles and clauses of the following Decrees:
a) Clauses 1 and 2, Article 1 of Decree No. 136/2018/ND-CP dated October 5, 2018 of the Government amending a number of articles of Decrees related to investment and business conditions in the field of natural resources and environment;
b) Article 11 of Decree No. 104/2022/ND-CP dated February 21, 2022 of the Government amending and supplementing a number of articles of the Decrees related to the submission and presentation of household registration books and temporary residence books when performing administrative procedures and providing public services.
