According to Article 22 of Decree 16/2022/ND-CP, the administrative penalty for violations of regulations when a specific construction incident occurs is as follows:
(1) Fine from VND 10,000,000 to VND 20,000,000 for one of the following acts:
- Not or delay in reporting when there are construction incidents or incidents that cause unsafe labor.
- Not preparing a construction incident file according to regulations.
(2) Fine from VND 40,000,000 to VND 60,000,000 for one of the following acts:
- Not organizing the protection of the construction site or arbitrarily demolishing or clearing the site without approval from the competent authority.
- Failure to handle and overcome the consequences of construction incidents or incidents that cause unsafe labor.
(3) Remedial measures:
- Forced to report in writing to the competent authority for the act specified in Point a, Clause 1, Article 22 of Decree 16/2022/ND-CP.
- Establish a construction incident file for the act specified in Point b, Clause 1, Article 22 of Decree 16/2022/ND-CP.
- Forced to organize the protection of the site of the construction incident with the act specified in Point a, Clause 2, Article 22 of Decree 16/2022/ND-CP.
- Forced to handle and remedy the consequences of the act specified in Point b, Clause 2, Article 22 of Decree 16/2022/ND-CP.
Thus, the administrative penalty for violations of regulations when a construction incident occurs in 2025 is according to the above regulations.
Note: The above fine level applies to organizations. The fine for individuals is 1/2 of the fine for organizations committing the same administrative violation. (Clause 3, Article 4 of Decree 16/2022/ND-CP)
