Decree 261/2025/ND-CP amending and supplementing a number of articles of Decree 100/2024/ND-CP detailing a number of articles of the Housing Law on the development and management of social housing and Decree 192/2025/ND-CP detailing a number of articles and measures to implement Resolution 201/2025/QH15 in 2025 on a number of specific mechanisms and policies for the development of social housing.
Pursuant to Clause 2, Article 1 of Decree 261/2025/ND-CP amending and supplementing Clause 1 and Clause 2, Article 30 of Decree No. 100/2024/ND-CP as follows:
Article 30. Income conditions
1. For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, the following income conditions must be ensured:
a) In case the plaintiff is unmarried or confirmed single, having an actual average monthly income of not more than 20 million VND shall be received according to the Salary and Salary Table confirmed by the agency, unit or enterprise where the subject works.
In case the petitioner is an unmarried person or is confirmed to be single and raising a child under the age of majority, the actual average monthly income received shall not exceed 30 million VND as calculated in the Salary Table, confirmed by the agency, unit or enterprise where the subject works.
b) In case the plaintiff is married according to the provisions of law, the plaintiff and his/her husband (husband) with a total average monthly income shall receive no more than 40 million VND in equity according to the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
c) The time to determine income conditions as prescribed in Point a, Point b of this Clause is within 12 consecutive months, calculated from the time the competent authority implements the confirmation.
d) Based on the conditions and income levels of each sector in the area, preferential housing policies for cadres, civil servants, and public employees, and the number of dependents as prescribed by law, the Provincial People's Committee may decide on the coefficient for adjusting the income level prescribed in Point a and Point b of this Clause but not exceeding the ratio between the average income per capita in the locality compared to the average income per capita of the whole country; decide on policies to encourage access to social housing for beneficiaries of social housing support policies with three (03) dependents or more in the same household.
2. In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a Labor Contract, it must ensure the income conditions as prescribed in Clause 1 of this Article and be confirmed by the police agency at the commune level where he/she is residing or temporarily residing or currently residing.
Within 7 days from the date of receipt of the confirmation request, the police agency at the commune level where the subject is residing or temporarily residing or at the time the subject requests confirmation shall base on the information of the population database to confirm the income conditions".
