Tay Ninh Provincial People's Committee has just requested departments, agencies, branches and Commune and Ward People's Committees to rectify and strengthen state management of land and construction. According to the Provincial People's Committee, along with the development process, the demand for land use to implement investment projects, key projects, technical infrastructure, industrial zones, clusters, urban areas and services is increasing. However, in some localities, especially in areas that are and will be implementing key projects, there is still a situation of arbitrary leveling of ground, changing land use purposes to subdivide and sell land plots.
Some cases also donate land to build roads to form spontaneous residential areas, build works on land that are not in accordance with regulations, collect and speculate on land. These acts cause difficulties for management, especially compensation, support, and resettlement when the State recovers land.
The Provincial People's Committee requests the People's Committees of communes and wards to regularly inspect and strictly manage the current status of land use in areas with key projects and works, where land acquisition notices have been issued or have been planned.
In receiving and resolving dossiers for land use purpose conversion, land plot separation, transfer of rights combined with land use purpose conversion, localities must strictly check the conditions and bases according to regulations; do not let the purpose conversion be exploited for speculation, land collection, affecting the legitimate residential land use needs of people.
Cases of illegal loading and unloading, leveling ground, self-opening roads, donating land to build roads to subdivide plots, separate plots, transfer land in violation of regulations, forming spontaneous residential areas must be promptly prevented and handled. The province also requests not to let illegal construction or construction on land for improper purposes arise, causing difficulties for compensation, site clearance and land management.
Notably, the Chairman of the Commune-level People's Committee must be responsible to the Chairman of the Provincial People's Committee if there is loose management, lack of inspection, slow detection or slow handling of violations in the area.
The Department of Agriculture and Environment is assigned to direct the updating and adjustment of land changes; strengthen inspection of land use purpose conversion, plot separation, subdivision, sale of land plots and construction works on land that are not for the right purpose. The Department of Construction strengthens inspection of construction order, guides handling of violations, especially in areas where key projects are being implemented.
Departments, agencies, branches and People's Committees of communes and wards are required to seriously implement, promptly inspect, handle or propose handling of violations in the management field.
