The Ministry of Agriculture and Environment received a petition from voters of Quang Ngai province sent after the 9th Session of the 15th National Assembly. The content of the recommendation is as follows: "It is recommended to continue reviewing, amending and supplementing legal regulations related to land recovery, compensation, support and resettlement, ensuring publicity, transparency, closer to reality and in accordance with the legitimate rights of the people".
Regarding this proposal, the Ministry of Agriculture and Environment has the following opinion: The 2024 Land Law stipulates the principle of compensation, support, and resettlement when the State reclaims land must ensure democracy, objectivity, fairness, publicity, transparency, timeliness, and compliance with legal regulations; for the common interests of the community and for the sustainable, civilized and modern development of the community and the locality; attention to social policy beneficiaries and direct agricultural producers (Article 91).
In the recent past, implementing the policy of arranging administrative units at all levels and building a model of organizing local government at 2 levels, implementing the assignment of the Government and the Prime Minister, the Ministry of Agriculture and Environment has organized a review of the provisions of the Land Law and documents detailing and guiding the implementation of the Law, and promptly proposed the Government to issue Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of local authorities at 2 levels, decentralization and delegation in the field of land and Decree No. 226/2025/ND-CP dated August 15, 2025 of the Government regulating the amendment and supplementation of a number of articles of decrees detailing the implementation of the Land Law.
Accordingly, the contents of regulations on land recovery, compensation, support and resettlement have been amended and supplemented to ensure publicity, transparency, suitability to reality, and ensure the legitimate rights of the people.
To continue to fully and promptly institutionalize the Party's viewpoints and policies and the State's laws on land policies in general, policies on land acquisition, compensation, support and resettlement when the State reclaims land in particular in Resolution No. 18-NQ/TW and Resolution No. 69-NQ/TW dated July 19, 2025, the Ministry of Agriculture and Environment is continuing to study, advise and report to competent authorities to amend and supplement the 2024 Land Law and guiding documents for implementation with the goal of freeing up land resources to serve socio-economic development, reducing complaints, increasing people's confidence, creating a transparent and stable investment environment, ensuring the rights of land users, meeting the socio-economic development requirements of the country in the current period.
