Red book issuance for 19.1 hectares of land in violation of regulations
On the morning of December 24, the Dak Nong Provincial Inspectorate said that the Gia Nghia City People's Committee had issued 37 red books with an area of 19.1 hectares in Quang Thanh ward to the wrong subjects, for the wrong purposes and with the wrong land origin.
The main responsibility for reviewing, confirming and proposing the issuance of red books belongs to the People's Committee of Quang Thanh ward and related individuals in the period 2007-2020.
The examination and confirmation of eligibility belongs to the Gia Nghia City Land Registration Office Branch. The Gia Nghia City Department of Natural Resources and Environment is responsible for advising on the issuance of red books.
Gia Nghia City People's Committee is responsible for State management of the entire process of granting these 37 red books.
Previously, in May 2017, the People's Committee of Dak Nong province reclaimed more than 1,900 hectares of forestry land from Gia Nghia Forestry One Member Co., Ltd. (Gia Nghia Company - dissolved) and handed it over to the People's Committee of Gia Nghia city for management.
However, Gia Nghia City’s management was found to be lax, leading to the issuance of 37 red books in violation of regulations. Of these, 27 red books with an area of about 8.7 hectares were issued from 2008 to May 2017, before the Provincial People’s Committee reclaimed the land.
The remaining 10 red books with an area of over 10.4 hectares were granted after Gia Nghia City received the handover. The land plots with red books have all or part of the area within the land area of over 1,900 hectares assigned from Gia Nghia Company.
This land area was originally planned as forestry land but was granted for agricultural purposes. The issuance of the red book still had many errors in the records and procedures, such as not consulting with the residential area, lacking a certificate confirming the origin and time of land use, or not having enough legal basis.
It is worth mentioning that many archived records are incomplete, leading to inaccurate approval. Dak Nong Provincial Inspectorate has requested clarification of the responsibilities of individuals and units involved in this incident.
There are 17 plots of land transferred.
All 37 red books issued by Gia Nghia City People's Committee to people were not correct in terms of land use subjects, purposes and origins.
Of these, 17 plots of land were transferred, but the Gia Nghia City Land Registration Office Branch did not detect that these areas belonged to the forestry land of Gia Nghia Company, which was later assigned to the city for management.
According to the explanation of the Gia Nghia City Land Registration Office Branch, due to old and inadequate facilities and the Gia Nghia Forestry Company's land boundary map data not being updated, there were overlaps. Coordination between the branch and relevant agencies was also limited.
