On March 27, 2026, the Ministry of Agriculture and Environment issued Decision 1026/QD-BNNMT in 2026 on announcing new internal administrative procedures; amended and supplemented; the land sector under the state management functions of the Ministry of Agriculture and Environment was abolished.
Accordingly, based on the provisions of sub-item 5, Section A, Chapter I, Part II of the Appendix issued together with Decision 1026/QD-BNNMT in 2026 on the list of specific land valuation dossiers for cases under the authority of the Chairman of the Provincial People's Committee from March 27, 2026, including:
(1) The dossier submitted to the Land Valuation Appraisal Council specifically includes:
a) Document requesting appraisal of land price plan;
b) Submission of land price plan;
c) Explanatory report on building a land price plan, draft Certificate of Land Valuation;
d) Specific land valuation dossiers.
(2) Dossier submitted to the Chairman of the Provincial People's Committee to decide the specific land price includes:
- Submission on land price plans of agencies with land management functions;
- Report explaining the development of land price plans, Land valuation certificates;
- Document appraising the land price plan of the specific Land Price Appraisal Council;
- Minutes of the specific land valuation council meeting;
- Report on receiving, amending, and completing the land price plan according to the document appraising the land price plan of the specific Land Price Appraisal Council.
Based on point a, clause 2, Article 160 of the 2024 Land Law, it is stipulated as follows:
Article 160. Specific land price
2. The authority to decide specific land prices is regulated as follows:
a) The Chairman of the Provincial People's Committee decides the specific land price for cases of land allocation, land lease, permission to change land use purposes, recognition of land use rights, extension of land use rights, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of the starting price of land use rights auctions, determination of the value of land use rights when equitizing enterprises under the authority of the Provincial People's Committee according to the provisions of this Law;
Accordingly, the Chairman of the Provincial People's Committee will decide the specific land price for cases under the authority of land allocation, land lease or recognition of land use rights of the Provincial People's Committee, including:
- Land allocation, land lease;
- Allowing land use purpose conversion;
- Recognition of land use rights;
- Extending or adjusting the land use term;
- Adjusting detailed construction planning related to land;
- Land acquisition and compensation calculation;
- Determine the starting price of the land use right auction;
- Determine the value of land use rights when equitizing state-owned enterprises under the province's authority.
