On March 27, 2026, the Ministry of Agriculture and Environment issued Decision 1026/QD-BNNMT in 2026 on announcing new internal administrative procedures; amended and supplemented; the land sector under the state management functions of the Ministry of Agriculture and Environment was abolished.
Accordingly, based on the provisions of sub-item 5, Section A, Chapter I, Part II of the Appendix issued together with Decision 1026/QD-BNNMT in 2026 on the specific land valuation order for cases under the authority of the Chairman of the Provincial People's Committee as follows:
Step 1: The provincial-level land management agency is responsible for preparing specific land valuation dossiers.
Step 2: The provincial-level land management agency decides to order and assign tasks to public non-business units that meet the conditions to operate consulting to determine land prices or select consulting organizations to determine land prices in accordance with the law on bidding to determine specific land prices.
Step 3: The provincial-level financial agency submits to the Chairman of the Provincial People's Committee a decision to establish a specific land valuation council.
Step 4: The provincial-level financial agency submits to the Chairman of the Land Valuation Appraisal Council a specific decision to establish a Working Group of the Council.
Step 5: Organize land valuation:
- Proceed to determine specific land prices and provide information on investigation results, collect input information to agencies with land management functions;
- Develop a land price plan, draft a Land Valuation Certificate and send it to a land management agency.
Step 6: Provincial-level land management agency:
- Publicize the explanatory report on building the land price plan on the Electronic Information Portal;
- Inspect the completeness of the content of the explanatory report on building the land price plan;
- Submit to the Land Price Appraisal Council to specifically appraise the land price plan.
The dossier submitted to the Land Valuation Appraisal Council specifically includes:
- Document requesting appraisal of land price plan;
- Submission on land price plan;
- Report explaining the development of land price plan, draft Certificate of Land Valuation;
- Specific land valuation documents.
Step 7: The specific land price appraisal council appraises the land price plan and sends the land price appraisal document to the land management agency.
Step 8: The provincial-level land management agency organizes the implementation of receiving, explaining, amending, and completing the land price plan.
Step 9: The provincial-level land management agency submits to the Chairman of the Provincial People's Committee to decide the specific land price. The dossier includes:
- Submission on land price plans of agencies with land management functions;
- Report explaining the development of land price plans, Land valuation certificates;
- Document appraising the land price plan of the specific Land Price Appraisal Council;
- Minutes of the specific land valuation council meeting;
- Report on receiving, amending, and completing the land price plan according to the document appraising the land price plan of the specific Land Price Appraisal Council.
Step 10: In case the specific land price is applied to calculate compensation when the State recovers land according to the provisions of point e, clause 1, Article 160 of the 2024 Land Law, the commune-level land management agency shall provide a land price plan to units and organizations performing compensation, support, and resettlement tasks to develop a compensation, support, and resettlement plan; the appraisal and approval of the land price plan shall be carried out in accordance with the provisions of clause 3, Article 34 and clause 3, Article 35 of Decree 71/2024/ND-CP.
Step 11: The land management agency shall store and update it into the national land database and publicly announce the land price plan explanation report and land price decision on the Electronic Information Portal. Specific land valuation records shall be kept for at least ten years from the date of the specific land price approval decision of the competent state agency, unless otherwise provided by law.
Step 12: Within no more than 15 days from the date the Chairman of the Provincial People's Committee decides the specific land price, the land management agency sends the results of determining the specific land price to the Ministry of Agriculture and Environment according to Form No. 43 of Appendix II issued together with Decree 151/2025/ND-CP.
