Regulations on how to exploit data to identify land plots and works from 1. 9

From September 1, 2026, Decree No. 326/2026/ND-CP of the Government regulating the identification of locations officially takes effect.

Each location has only one unique identification code, complying with a unified structure nationwide, ensuring continuity and stability, and no duplication throughout the system. The objects designated as locations are land plots, architectural works, construction works, construction structures, geographical designations or any physical structures and other objects specified in the Appendix attached to this Decree.

The location identification code is a natural 12-digit sequence established by the location identification database. Each location is attached with a separate, non-duplicated identification code, ensuring stability, expansion and the ability to link, integrate, connect, share, and exploit information in the national database and specialized database.

Based on Article 7 of Decree No. 326/2026/ND-CP stipulating the exploitation of location identification data from the location identification database as follows:

Article 7. Exploiting location identification data from the location identification database

1. Location identification data is connected, shared, and exploited to serve state management and socio-economic development. The sharing and exploitation of location identification data must be for the right purpose, scope and authority; not requiring the provision of components of dossiers for resolving administrative procedures, but the information in the components of the dossier has data in the Location Identification Database.

2. Subjects and methods of information exploitation in the location identification database are specified as follows:

a) Organizations and individuals are allowed to publicly exploit data on location identification on the national identification application (VNeID);

b) State agencies, political organizations, socio-political organizations are allowed to exploit information in the Location Identification Database to perform functions and tasks through the national data sharing and coordination platform, electronic identification and authentication platform and other data integration and sharing platforms in accordance with the law on management, connection and sharing of digital data of state agencies;

c) Organizations and individuals are allowed to exploit their information in the Location Identification Database through the national identification application.

In case of exploitation of information of a person who has lost civil act capacity, a person with difficulty in perception, controlling behavior, a person under 14 years old, the consent of a legal representative or guardian must be obtained; in case the person is declared missing, the consent of the person managing that person's property must be obtained; in case the person has died, the consent of the heir must be obtained;

d) People who have lost civil act capacity, people who have difficulty in perception and controlling their behavior, people under 14 years old exploiting their information through legal representatives or guardians. The exploitation of information of the person declared missing is decided by the asset manager of that person;

e) Organizations and individuals not falling into the cases specified in points a, b, c and d of this clause are allowed to exploit data on location identification through organizations providing electronic authentication services and must pay information exploitation and usage fees.

In case there is a need to exploit other information in the location identification database, the consent of the owner or manager of that location must be obtained.
