Ms. T.T in Dong Thap reflected that, according to new regulations, when issuing red books, the names of "households" will no longer be recorded, but only the names of representatives or people with common land use rights. Therefore, when carrying out procedures to renew red books, members of Mr. Nguyen Van A's household agreed to let Mr. C and Mr. D represent them.
Based on Clause 4, Article 256 of the 2024 Land Law, the issuance and renewal of red books for members with common land use rights of households is done by members themselves and they are themselves responsible before the law.
This regulation does not require documents from competent authorities confirming the number of household members at the time of land allocation, land lease or land use right recognition.
Ms. T asked, does the change of representative in the red book require a written agreement between the members of the household confirmed by a competent authority, or does the registration of changes show that Mr. C and D represent the remaining member?
In the case of the red book mentioned above, if the household needs to issue a certificate to each member, is it possible?
The Ministry of Agriculture and Environment answers this question as follows:
The issuance of certificates for land plots under the use rights of households has been stipulated in principle in Clause 5, Article 135 of the 2024 Land Law, which stipulates the issuance of a certificate and full recording of the names of members with common land use rights on the certificate.
The determination of members with common land use rights of households to register their names on land use right certificates, ownership of assets attached to land is agreed upon by these members themselves and they are responsible before the law (which has included changing representatives in the Certificate), not stipulating that the above agreement must have confirmation from a competent authority.
At point a, clause 2, section VII, content C, Part V, Appendix 1 issued together with Decree No. 151/2025/ND-CP stipulating for cases of issuing and renewing certificates to fully record the names of members with common land use rights on certificates, the content in the Application for registration of land changes, assets attached to land according to Form No. 18 issued together with this Decree must show information on members with common land use rights of households.
