Clause 2, Article 12 of Circular 10/2024/TT-BTNMT stipulates information on people who are allocated land for management, land users, and owners of assets attached to land, specifically as follows:
Information about the name of the person allocated land for management, land users, owners of assets attached to land, inheritors of land use rights, ownership of assets attached to land who are foreign individuals, Vietnamese people residing abroad who are not eligible for a Certificate shall be determined according to personal information and legal entity documents specified in Clause 3, Article 12 of Circular 10/2024/TT-BTNMT and expressed as follows:
(1) For domestic individuals, overseas Vietnamese who are Vietnamese citizens (hereinafter referred to as individuals) not falling under the cases specified in point b of this clause, the following information shall be displayed: "Mr." or "Ms.", full name, date of birth.
Foreign individuals or people of Vietnamese origin residing abroad shall display the information: "Grandfather" or "Grandma", full name, date of birth, nationality;
(2) For husband and wife who share common property, which is land use rights, ownership of assets attached to land, the following information shall be displayed: "Ms." or "Mr.", full name, date of birth of husband or wife, followed by: "and husband (or wife): ... (showing husband's (or wife's) name)", followed by information on the basis for determining marital relations or information on documents proving marital relations.
In case there is an agreement between the wife and husband agreeing to write the wife's or husband's name on the Certificate, additional information about the agreement document shall be shown;
(3) For domestic organizations, religious organizations, affiliated religious organizations, foreign organizations with diplomatic functions, representative agencies of organizations under the United Nations, intergovernmental agencies or organizations, representative agencies of intergovernmental organizations, foreign-invested economic organizations, foreign organizations that own houses in Vietnam in accordance with the law on housing, (hereinafter referred to as organizations), the full name of the organization shall be shown;
(4) For residential communities, the name of the residential community is expressed as determined by the residential community;
(5) For cases where the land plot has many people sharing land use rights, many people sharing the ownership of assets attached to the land (collectively referred to as groups of land users, owners of assets attached to the land), the full names of those who have land use rights, ownership of assets attached to the land shall be displayed according to the provisions of points a, b, c and d, clause 5, Article 12 of Circular 10/2024/TT-BTNMT, except for cases where land use rights are for construction of apartment buildings.
In case a group of people using land and owning assets attached to land has an agreement to appoint a representative to stand in the name on the Certificate, additional information about the agreement document shall be shown;
(6) For households currently using land that register and issue first-time Certificates, complete information on members with common land use rights as prescribed in point a, clause 6, Article 12 of Circular 10/2024/TT-BTNMT shall be displayed.
In case there is an agreement to record the name of the household representative on the Certificate, additional information about the agreement document shall be shown;
(7) In case the owner of assets attached to land does not have land use rights, information about the owner of assets shall be displayed according to the provisions in points a, b, c and d of this clause, followed by: "To own assets, not have land use rights at land plot number ..., map sheet number ... in the form of ... (recording form of land lease, business cooperation, transactions on housing, ...) of ... (recording information of land users)"...
(8) In case there are many people who have inherited land use rights and ownership of assets attached to land but have not yet divided inheritance among each inherited person according to the provisions of civil law, the names of the inheritors must be shown as determined according to the provisions of points a, b, c and d, clause 8, Article 12 of Circular 10/2024/TT-BTNMT...
Information about land users on the red book includes "Mr." (or "Ms."), full name, year of birth, name and number of personal papers (if any), permanent address. Personal papers. According to current Vietnamese law, there are no specific regulations on the age to be named in the red book.
Thus, currently the law does not stipulate the minimum age to be named in the red book. Just having legal land use rights and having full personal papers, individuals, even if they are not yet 18 years old, can still be named in the red book; the management and establishment of transactions will be carried out by legal representatives.
