Loose management of forest land
According to the inspection conclusion, the forestry land fund managed by U Minh Ha Forestry One Member Limited Liability Company originated from the period of forestry farms and fishery farms in the period 1980-2002, then underwent many conversions, consolidations and reorganizations of the organization.
Since 1980, Minh Hai Provincial People's Committee has established 3 forestry farms, in which in 1983, Decision No. 74/QD-UB was issued to allocate land for the U Minh II canal bank in Khanh Hoa and Nguyen Phich communes (old) with a total area of 10, 410ha, including 7, 010ha east of Cai Tau River and 3, 400ha west of Cai Tau River.

Hiện nay, một phần khu đất này tiếp tục bị một số hộ dân tại ấp 2 và ấp 14 (xã Khánh Hòa cũ) lấn chiếm đất lâm nghiệp, yêu cầu giao phần đất 300m liền kề.
In the period 1992-2002, forestry farms were converted into 6 forestry and fishery farms, then there were 5 public utility forestry and fishery farms. During this period, the implementation of contracting according to Decree 01/CP was common, but lacked strict control. The Inspectorate clearly pointed out that when reviewing conversion, three groups of households simultaneously existed: households agreeing to receive contracts; households living legally but not receiving contracts; households illegally encroaching on forests.
The 1993 Land Law took effect, further narrowing the area of forestry land when a part was allocated to the locality to issue certificates to households. Meanwhile, the handover and storage of land records at this stage was lax, many records were no longer stored, causing great difficulties for subsequent management.
Contracting and using land for wrong purposes takes place on a large scale
According to the current status review, to date, the company is managing and using 24,133.33ha of land, of which forestry land is 23,355.22ha, and non-agricultural land is 778.11ha. This area is divided into 4,147.63ha directly managed by the company, 3,994.54ha of investment cooperation and 15,991.16ha of contracted land.
Currently, the company is contracting to 2,418 households and 1 collective unit (Cooperative 19/5). Through actual inspection and comparison of dossiers, the Inspectorate determined that many cases of using forestry land for improper purposes.
According to the inspection conclusion, there are 120 households receiving contracts using land for wrong purposes, with a total area of 287.26ha. Many households arbitrarily convert forest land to agricultural production, aquaculture, building houses, and solid works along canals and dykes.
Specifically in Sub-area 011 and Sub-area 026A (Nguyen Phich commune), the situation of bringing saltwater into forestry land has been taking place from 2014 to now. The Inspectorate recorded 188 violating households, with a total area of 751.66ha, of which 545.86ha is forestry planning land.
In Sub-area 026A, there are 48 households that do not replant forests after exploitation, arbitrarily plant rice and raise shrimp on an area of 117.81ha. In Sub-area 011, Song Trem Inter-sub-area, there are 119 households using land for wrong purposes on an area of 633.85ha. Notably, the case of Ms. Ha Thu Thuy in Sub-area 048, U Minh I Inter-sub-area has arbitrarily transferred to sell contracted land and build illegal houses for 5 other households on an area of 7.26ha; to date, the case has not been completely resolved.
The Inspectorate also pointed out the situation of illegal transfer of contracts under the form of "selling labor product". Statistics show that there are 62 cases of transfer not through the company, with a total area of 357.03ha, scale from 0.82ha to 9.79ha each case.
Not only stopping at contracting, the handover of land outside the field without a decision to recover, allocate land, or lease land also takes place in some areas. Typically, the 88.18ha land area in Sub-area 032, hamlet 14, U Minh commune, currently has 16 households living and cultivating over 29.36ha, bringing saltwater for aquaculture on forestry land.
The Inspectorate assessed that the above-mentioned shortcomings and violations show that the management and use of forest land at U Minh Ha One Member Limited Liability Forestry Company still has many shortcomings, prolonged for many years, arising disputes, land use violations and causing difficulties for arranging and renovating forestry enterprises according to regulations.
