Late transfer of the red book can be fined up to 6 million VND, late submission of personal income tax declaration can be fined up to 25 million VND.

Penalty for late transfer of red book

According to the 2024 Land Law, land users must complete the name change procedure within 30 days from the date of notarization of the real estate sale and transfer contract. If this deadline is exceeded, the fine is as follows:

Individual violator: Fine from 2-3 million VND.

Organizing violations: Fine from 4-6 million VND.

In addition to fines, violators are required to register changes in land use rights according to regulations.

Late submission of tax declaration documents will also be heavily fined

People must submit personal income tax declaration within 10 days from the date of tax obligations arising from land use rights transfer, donation, and inheritance activities. If late, the fine will be applied according to the late payment period as follows:

1 - 5 days late (with mitigating circumstances): Warning.

1 - 30 days late: Fine 2 - 5 million VND.

Late 31 - 60 days: Fine 5 - 8 million VND.

Late 61 - 90 days: Fine 8 - 15 million VND.

Late payment over 90 days: Fine 15 - 25 million VND.

Who is responsible for late transfer of red book?

According to Decree 123/2024/ND-CP, the buyer or the donator is responsible for carrying out procedures for registering land changes. If delayed, the violator will be punished according to regulations.

Naming on time not only helps avoid being fined but also ensures legal rights when owning and using land, while avoiding legal disputes in the future.

Competent authority to register land changes according to the 2024 Land Law

According to Article 136 of the 2024 Land Law, the authority to register land changes is assigned to the following agencies:

The Land Registration Office shall register the following subjects: Domestic organizations; Religious organizations, affiliated religious organizations; Foreign organizations with diplomatic functions; Economic organizations with foreign investment; Foreign organizations, foreign individuals.

The Branch of the Land Registration Office is responsible for registering changes for: Individuals; Communities; Vietnamese people residing abroad.
