Form of inheritance of land use rights
There are two forms of inheritance of land use rights: inheritance by will and inheritance by law.

Procedures for transferring red book ownership for inherited real estate
Step 1: Carry out inheritance declaration procedures at the Notary Office.
Documents to prepare include: identity papers, residence confirmation papers, death certificate of the deceased, will, documents proving relationship with the deceased and the inheritor, red book.
Step 2: Prepare a change registration form.
Within 30 days from the date of completion of division of land use rights as inherited property, the inheritor must register the change, otherwise he/she will be subject to administrative sanctions.
Step 3: Submit application.
The heir can submit the application to the People's Committee of the province where the land is located if needed. The application will then be transferred to the Land Registration Office.
Step 4: Land office receives and processes the application.
Upon receiving the notice, the heir is obliged to pay fees such as: red book issuance fee, land use fee, registration fee, file appraisal fee...
Step 5. Return results.
The time to return the results of the red book transfer is no more than 10 days from the date of receiving valid documents; no more than 20 days for mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions.
