Pursuant to Article 7 of Decree 101/2024/ND-CP effective from August 1, 2024, the land division procedure is carried out as follows:
1. Prepare documents
You need to prepare a set of documents including:
- Application for land division according to Form No. 01/DK issued with the Decree.
- Land division drawing made according to Form No. 02/DK by the Land Registration Office or a licensed surveying unit.
- Certificate of land use rights issued or notarized, certified copy.
2. Submit application
Submit the application to the application receiving agency specified in Clause 1, Article 21 of this Decree. The application receiving agency will issue a receipt of application and schedule a return of results.
3. File processing
The Land Registration Office or the Branch of the Land Registration Office will check the documents and compare them with the provisions of Article 220 of the Land Law to determine the conditions for land division. If the documents meet the conditions, they will confirm the Land Division Application and the Land Division Drawing.
4. Issuance of Certificate
After completing the procedures, the Land Registration Office will issue a Land Use Right Certificate for the land plots after separation and hand them over to the grantee.
Note that you need to ensure that the land plot after separation must meet the minimum area as prescribed by the Provincial People's Committee.
