The authority to issue red books in Hanoi latest in 2025
On July 1, 2025, the Hanoi People's Committee issued Decision 40/2025/QD-UBND amending the Regulations related to land in Hanoi. Including amending the authority to issue red books as prescribed in Article 8 of Decision 61/2024/QD-UBND.
Pursuant to Clause 2, Article 2 of Decision 40/2025/QD-UBND amending and supplementing Article 8 as follows: The authority to issue certificates of land use rights and ownership of assets attached to land for the first time to land users and owners of assets attached to land as prescribed in Clauses 1, 2, 5, 6 and 7, Article 4 of the Land Law
- The Department of Agriculture and Environment implements:
+ Issuing a Certificate of land use rights and ownership of assets attached to land to land users and owners of assets attached to land under their authority to allocate land and lease land, permitting change of land use purpose, deciding on land use form of the City People's Committee, Chairman of the City People's Committee prescribed in Decree No. 151/2025/ND-CP of the Government not falling under the cases specified in Point b, Clause 1 of this Article.
+ Issuing certificates of land use rights and ownership of assets attached to land for land areas of agricultural and forestry companies that are allowed to continue to be used according to the approved plan prescribed in Point c, Clause 1, Article 181 of the Land Law.
- Chairman of the People's Committee at the commune level shall issue certificates of land use rights and ownership of assets attached to land to land users and owners of assets attached to land under their authority to allocate land and lease land, permit change of land use purpose, decide on land use form of the People's Committee at the commune level, Chairman of the People's Committee at the commune level as prescribed in Decree No. 151/2025/ND-CP.
Chairman of the People's Committee at the commune level has the authority to issue red books
- Point h, Clause 1, Article 5 of Decree 151/2025/ND-CP stipulates the authority to issue red books of the Chairman of the People's Committee at the commune level as follows:
The authority of the People's Committee at the district level according to the provisions of the Land Law shall be transferred to the Chairman of the People's Committee at the commune level, including:
+ Issuance of Certificate of land use rights and ownership of assets attached to land as prescribed in Point b, Clause 1, Article 136 and Point d, Clause 2, Article 142 of the Land Law.
* Article 4 stipulates that land users are allocated land, leased land, or recognized land use rights by the State; are using land stably, and are eligible for a certificate of land use rights and ownership of assets attached to land that have not been granted a certificate of land use rights, a certificate of house ownership rights and land use rights, a certificate of land use rights, house ownership rights and other assets attached to land, a certificate of land use rights and ownership of assets attached to land; receive land use rights; sublease land according to the provisions of this Law, including:
- Domestic organizations include:
+ State agencies, agencies of the Communist Party of Vietnam, armed forces units, the Vietnam Fatherland Front, socio-political organizations, socio-political organizations - occupations, social organizations, socio-professional organizations, public service units and other organizations as prescribed by law;
+ Economic organizations as prescribed by the Law on Investment, except for the cases specified in Clause 7 of this Article (hereinafter referred to as economic organizations).
- Religious organizations, affiliated religious organizations.
- Foreign organizations with diplomatic functions include diplomatic representative agencies, consular agencies, and other foreign representative agencies with diplomatic functions recognized by the Vietnamese Government; representative agencies of organizations under the United Nations, intergovernmental agencies or organizations, representative agencies of intergovernmental organizations.
- Vietnamese people residing abroad.
- Foreign-invested economic organizations.
