Speaking to Lao Dong newspaper, lawyer Truong Anh Tu (TAT Law Firm) said: “Delay in issuing red books can lead to the application of a new, higher land price list, significantly increasing financial obligations such as land use fees, registration fees and other fees. In Ho Chi Minh City, the new land price list has increased by an average of 50%-100%.
For example, a plot of land in District 9 (now Thu Duc City) previously had a residential land price of 20 million VND/m2, now it has increased to 40 million VND/m2, causing the amount of land use fee to be paid to double" - said lawyer Truong Anh Tu.
As the new land price list increases, lawyers also recommend that people complete their application for a Land Use Right Certificate before the new land price list takes effect. For those who have difficulties with the application, they should seek support from the environmental resources agency or legal experts for quick processing.
Latest red book cost
People who need to make a red book must pay a number of fees including: Registration fee, Certificate issuance fee, land use fee (if any), and file appraisal fee.
Pursuant to Decree 10/2022/ND-CP and Circular 13/2022/TT-BTC, the registration fee payable for real estate when registering land use rights and house ownership rights remains the same as before, specifically the fee collection rate is: 0.5%.
The method for determining the registration fee payable is as follows:
Registration fee payable = 0.5% x Registration fee calculation price
The price for calculating registration fee for land is the land price in the Land Price List issued by the Provincial People's Committee at the time of registration fee declaration.
The land area subject to registration fee is the entire area of the land plot under the legal use rights of the organization or individual, determined by the Branch of the Land Registration Office and provided to the Tax authority.
Certificate issuance fee:
According to Clause 5, Article 3 of Circular 85/2019/TT-BTC, the fee for granting a Certificate is decided by the Provincial People's Council, so the collection rate for each province or city may be different.
Application appraisal fee:
The fee for assessing the application for a Certificate is a fee determined by the Provincial People's Council, so some provinces and centrally-run cities will not have to pay the fee when issuing the Certificate for the first time. In addition, people may have to pay an additional measurement fee.
