Recently, the City People's Court has just issued a decision to suspend the appeal trial of a civil case on "District of land use rights and forced demolition of illegal construction works" by the plaintiff, Mr. Do Van Huu, and the representative authorized by the plaintiff, Ms. Vu Thi Tuyen, who submitted a petition to voluntarily withdraw all the appeal.
On the afternoon of October 22, speaking with Lao Dong, Ms. Tran Thi Kim Loan - the owner of the wrongly built land plot - said that it is expected that in 19 days, Ms. Loan's family will break ground to build a house on the land plot next to the plot that Mr. Do Van Huu was mistakenly building. Ms. Loan's family also notified the local authorities to persuade Mr. Huu's household to be informed and urgently relocate from the mistakenly built land.
"From now until the day I built the house, Mr. Huu still has the opportunity to ask the "genie" to move the house to reduce construction costs. If after I build a house on the plot of land next to it, Mr. Huu's family can only demolish the house to return the plot of land to my family" Ms. Loan shared.
Previously, as reported by Lao Dong, on September 23, 2024, Mr. Nguyen Dang Ca and Ms. Tran Thi Kim Loan received the transfer of land use rights with an area of 60 m2 at plot No. 4856, map sheet No. 03 issued by the People's Committee of Thuy Nguyen district, Hai Phong city (old) on October 19, 2024 in village 7, Kien Bai commune (now Kien Bai 7 residential group, Thien Huong ward).
However, on November 12, 2024, when Ms. Loan's family came to inspect, they suddenly saw that the land was being occupied by the family of Mr. Do Van Huu and his wife, Ms. Vu Thi Tuyen (both residing in village 7, Kien Bai commune) to build a 2-storey house.
On November 20, 2024, after receiving a petition from Ms. Tran Thi Kim Loan and her husband about the above incident, the People's Committee of Kien Bai commune held a working session with the parties. At the meeting, Mr. Do Van Huu and his wife said that the construction of a house on the land of Ms. Tran Thi Kim Loan was due to a mistake, because Mr. Do Van Huu's family also bought a plot of land, 4 plots from the location of this plot of land. The People's Committee of the commune requested to stop construction at the wrong location.

On November 28, the Working Group of the People's Committee of Kien Bai commune inspected and discovered that there were still 3 workers at the scene constructing houses. The working group has drawn up a working record, requesting Mr. Do Van Huu's household to stop construction. However, Mr. Huu's family still deliberately continues to build and complete the house. Therefore, Ms. Loan and her husband have initiated a lawsuit in the above case.
On August 11, the People's Court of Region I - Hai Phong held a first-instance trial of the above case and issued Judgment No. 08/2025/DS-ST. Accordingly, Mr. Do Van Huu and Ms. Vu Thi Tuyen were forced to move all their belongings and dismantle all construction works on plot 4856, map sheet No. 03, in Residential Group 7, Kien Bai area, Thien Huong ward to return the above plot of land to Mr. Nguyen Dang Ca and Ms. Tran Thi Kim Loan.
The People's Committee of Thien Huong Ward requested Mr. Do Van Huu's household to strictly comply with the verdict; coordinate with the civil enforcement agency to dismantle the construction and hand over the land to the legal owner. However, instead of serving the verdict, Mr. Do Van Huu filed an appeal to the City People's Court.
