- Specifically, in the case of reselling social housing to project investors:
The reseller must carry out the contract liquidation procedure with the investor.
The resale shall comply with the contents stated above and the provisions of the law on real estate business and the law on land.
- In case of reselling social housing to other subjects eligible to buy or lease-purchase social housing, the following regulations shall apply:
+ Buyers of social housing must have documents confirming the subjects and conditions according to the instructions of the Minister of Construction, the Minister of National Defense and the Minister of Public Security and submit the application to the Department of Construction of the locality where the project is located to determine the correct subjects and conditions according to the provisions of Point d, Clause 1, Article 38 of Decree 100/2024/ND-CP.
Accordingly, the investor of the social housing construction investment project is responsible for sending the List of subjects expected to be eligible to buy social housing in order of priority to the Department of Construction of the locality where the project is located to organize an inspection to correctly identify the subjects eligible to buy social housing and exclude those who have registered to buy social housing in this project who have purchased or leased social housing, and have received housing support from the State in any form in the province or centrally-run city where the social housing project is located.
+ At the same time, the reseller must complete the contract liquidation procedures with the project investor (if any). The resale shall be carried out in accordance with the provisions of Point d, Clause 1, Article 89 of the 2023 Housing Law and the provisions of the law on real estate business and the law on land.
