Pursuant to Article 192 of the 2024 Land Law, it is specifically regulated as follows:
Article 192. Concentrating on agricultural land
1. Concentrating on agricultural land is increasing the area of agricultural land to organize production through the following methods:
a) Conversion of agricultural land use rights according to the plan of consolidating land plots and exchanging plots;
b) Lease of land use rights;
c) Cooperation in production and business using land use rights.
Thus, the implementation of converting agricultural land use rights according to the plan of consolidating land plots and exchanging plots is an agricultural land concentration activity, so the procedure for granting red books will be implemented according to the provisions of Article 77 of Decree 102/2024/ND-CP (amended and supplemented by Clause 12, Article 4 of Decree 226/2025/ND-CP) as follows:
(1) The competent land management agency shall submit to the competent authority or person to sign and issue a Certificate on the basis of the land use plan; issue a Certificate to the granted person; transfer a set of documents accompanying the previously issued Certificate (if any), 1 copy of the issued Certificate to the Land Registration Office or a Branch of the Land Registration Office to prepare and update cadastral records and land database.
(2) In cases where the locality has carried out the consolidation and exchange of agricultural land plots before the effective date of Decree 226/2025/ND-CP but there is no plan for consolidation and exchange of land plots or the plan for consolidation and exchange of land plots has not been approved by the competent authority and in fact people have used the land stably after consolidation and exchange of plots, the issuance of a Certificate of land use rights and ownership of assets attached to land shall be carried out according to regulations on the issuance of the first Certificate.
Thus, when implementing the conversion of agricultural land use rights according to the plan of consolidating land plots and exchanging plots, the competent land management agency shall submit to the competent authority or person to sign and issue a Certificate on the basis of the land use plan.
For cases that have been forced to increase or exchange plots before the effective date of Decree 102/2024/ND-CP but there is no plan to increase or change plots or a plan to increase or change plots that has not been approved by the competent authority and in fact people have used land stably after the increase or change of plots, the issuance of red books will be carried out according to regulations on the issuance of the first Certificate.
