Procedures for granting red books when buying and selling houses apply from 1.7.2025
Pursuant to Part X, Chapter C of Appendix I issued with Decree 151/2025/ND-CP, the procedures for granting red books when transferring land use rights from July 1, 2025 are as follows:
(1) Within the prescribed time limit of the law on housing and the law on real estate business, the project investor is responsible for submitting a set of documents to the One-stop Department or the Land Registration Office or Branch of the Land Registration Office.
The dossier receiving agency shall:
- Check the completeness of the dossier components and issue a dossier receipt and schedule a return of results.
+ In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.

- Documents on the acceptance of houses and construction works for exploitation and use in accordance with the provisions of the law on construction in cases of receiving transfers of houses and construction works;
- Documents on eligibility for buying and selling houses for individuals to build houses themselves in cases of transferring land use rights with technical infrastructure according to the provisions of the law on real estate business;
- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree 151/2025/ND-CP by transferees of land use rights and house ownership rights.
- Housing sale and purchase contracts according to the provisions of law;
- Minutes of handover of houses, land, construction works, construction items;
- Certificate issued to the project investor;
- Documents proving the completion of financial obligations in cases where the Land Registration Office receives a document from the competent authority about the project being adjusted to a detailed construction plan, which creates financial obligations according to the provisions of law.
(2) In case the transferee of land use rights and house ownership directly carries out the procedures for registration and issuance of Certificates of land use rights and ownership of assets attached to land, the dossier shall be submitted to the One-stop Department or the Land Registration Office or the Branch of the Land Registration Office. The dossier receiving agency performs the work specified in Section 1, Part X of the Appendix issued with Decree 151/2025/ND-CP.
- In case the dossier receiving agency is the One-stop Department, the dossier shall be transferred to the Land Registration Office. The dossier includes documents as prescribed in Section 1, Part X of the Appendix issued with Decree 151/2025/ND-CP or documents specified in Points c, d and dd, Section 1, Part X of the Appendix issued with Decree 151/2025/ND-CP.
(3) The Land Registration Office is responsible for:
- Check the completeness of the dossier components according to regulations;
- send the Information Transfer Form to determine financial obligations on land according to Form No. 19 issued with Decree 151/2025/ND-CP to the tax authority to determine and notify the transferee of land use rights, house ownership rights, construction works, construction items;
- Update and edit cadastral records and land databases;
- Issuing red books (Certificate of land use rights, ownership of assets attached to land) to transferees of land use rights, ownership of houses, construction works, construction items; confirming changes on the Certificate issued to the investor, in which the area under common use rights with others will be adjusted to change to the form of common use;
- Award the Certificate of land use rights, ownership of assets attached to land or transfer the Certificate to the project investor to give to the granted person in case the project investor submits documents to carry out procedures.
- In case the dossier receiving agency is the One-stop Department, the dossier shall be transferred to the Land Registration Office.
