On June 19, 2025, the Ministry of Construction issued Decision 872/QD-BXD in 2025 announcing the amended, supplemented, replaced, and abolished administrative procedures in the field of housing and real estate business according to regulations on decentralization and delegation under the management of the Ministry of Construction, effective from July 1, 2025.
Accordingly, based on Section 1, Sub-section I, Section B, Part II issued with Decision 872/QD-BXD in 2025, the procedures for transferring all or part of real estate projects (provincial level) are as follows:
(1) Implementation procedures
- Real estate project investors submit a set of documents to the provincial People's Committee (or the state management agency for real estate business at the provincial level where the project is authorized by the provincial People's Committee).
- Within 20 days from the date of receiving a complete and valid dossier, the People's Committee at the provincial level is responsible for collecting opinions from relevant local agencies and organizing the appraisal of the transfer dossier, issuing a decision allowing the transfer or having a written notice clearly stating the reasons why the project or part of the real estate project is not eligible for transfer.
In case the provincial-level state management agency on real estate business is authorized by the provincial People's Committee, within 20 days from the date of receiving a complete and valid dossier, this agency is responsible for consulting with relevant local agencies, organizing the appraisal of the dossier and submitting it to the provincial People's Committee for decision.
In case the transferee is an economic organization with foreign investment capital as prescribed in Clause 4, Article 10 of the Law on Real Estate Business 2023, with projects or part of real estate projects transferred in areas of islands; communes and wards in border areas; communes and wards in coastal areas and other areas affecting national defense and security as prescribed, the People's Committee of the province where the project is located must seek opinions from the Ministry of National Defense and the Ministry of Public Security on ensuring national defense and security.
- Within 7 days from the date of receipt of the document or dossier to collect opinions from the Provincial People's Committee (or the state management agency on real estate business at the provincial level), the agency is allowed to collect opinions on the content under the state management scope assigned to the contents specified in Articles 4, 39 and 40 of the Law on Real Estate Business 2023.
