HCMC approves businesses to pilot commercial housing construction on 54 land plots

Ho Chi Minh City approved real estate businesses to pilot commercial housing projects on 54 land plots, with a total area of over 6.5 million m2.

On November 7, the Ho Chi Minh City People's Committee issued a document approving real estate businesses to pilot commercial housing projects on 54 land plots.

These lands were previously approved in principle by the Ho Chi Minh City People's Council at the meeting on September 29, 2025.

The announcement of the Ho Chi Minh City People's Committee is the basis for real estate business organizations and relevant state agencies to carry out the next steps to implement commercial housing projects through agreements on receiving land use rights or having land use rights as prescribed in Resolution No. 171/2024/QH15 dated November 30, 2024 of the National Assembly, Decree No. 75/2025/ND-CP dated April 1, 2025 of the Government and other relevant legal documents.

This document takes effect from November 7, 2025, requiring relevant agencies, organizations and individuals to create favorable conditions for projects to be implemented in accordance with regulations.

According to current regulations of the Housing Law and the Land Law, businesses that want to invest in commercial housing must have legal residential land, that is, must go through the State to be allocated or leased land.

Many land plots, although included in the urban development planning, have not been recognized as residential land, causing a series of projects to be "shelved" for a long time because they cannot complete legal procedures.

With Resolution No. 171/2024/QH15, businesses are allowed to negotiate directly with people to receive land use rights to implement commercial housing projects, even on agricultural land, as long as they are in accordance with local planning and land use plans.

According to the attached list, 54 approved land plots have a total area of over 6.5 million m2, of which over 213,000 m2 of rice-growing land needs to be converted.

Notably, most of the area of about 6.3 million m2 was previously located in the Ba Ria - Vung Tau area.

Some large-scale projects with rice growing areas need to be significantly converted, such as: My Xuan Housing Area (17,800 m2 rice growing land/147,037 m2 total area), New Urban Company Housing Area (52,500 m2/54,139 m2), Lan Anh Thinh Vuong Residential Area (more than 60,000 m2/75.197 m2), My Phu Residential Area (more than 33,600 m2/48,741 m2), BIDC Phu My Residential Area (more than 10,300 m2/68,662 m2)...

The pilot projects will be implemented in three forms:

Accepting land use rights - applied to large-scale ecological housing areas such as Phu Thinh Eco-housing Area (410.688 m2), Phu Gia Eco-housing Area (444.484 m2), An Phu Eco-housing Area (130.870 m2), Gia Hung High-end Housing Area (118.675 m2)...

Currently having land use rights - for projects where businesses have owned land, including OSC High-rise Apartment Complex combined with commercial services, Le Loi Street Low-rise Housing Complex, Long Hung - Charm City Vung Tau High-end Complex...

Combining two forms (currently having land use rights and receiving land use rights) - applied to projects such as Sao Mai Phu My Supermarket Complex, 24-storey Apartment - Ward 16 Residential Area (formerly District 8), My Phu Residential Area...
